contractors. T'he"isarn'e are\ufb02eattracted hereunvder:<\/p>\n
(a) Where pro.vldin”g.qtrleylrnaterlal (subjected to royalty) is
\nthe V’responsibillty,’of  contractor and the Department<\/p>\n
.– provides the contractor with specified borrow areas, for
\n eirtracftion “of\u00abvthe.’required construction material, the
\ncontractor will be liable to pay royalty charges for the<\/p>\n
 — _(n;lnor mineral) extracted from such areas,<\/p>\n
‘ :r’r.’=.=.4:;ag.:\u00ab.c:fi:z;’e of whether the contract is a item rate
\nC.on’tract or a lump sum contract. Hence deduction of
\n‘roy:alty charges in such cases will be legal. For this
\nptlrpose non~execution of mining lease is not relevant,<\/p>\n
 as the liability to pay royalty arises on account of the<\/p>\n

Where the contractor uses .ma\u20ac?eri'al_purchased in open
\nmarked, that is rnajterial purchased fron*., private sources<\/p>\n
like quarry lease h.oldei5_; or private duarry owners, there<\/p>\n
 no:1li'ab.ility'"lpn .,the_'vcont'ractor to pay any royalty<\/p>\n
charges.'<\/p>\n
In cases 'cover_ed~.by"paras (b) and (c) the Department<\/p>\n
cannot recover or deduct any royalty from the bills of
\n' the c'on'tractor"and if so deducted, the Department will<\/p>\n
b._e"bound to refund any amount so deducted or collected<\/p>\n
. toithe contractor.\n<\/p>\n
subject to the above, collection of royalty by the<\/p>\n
