\tThis
\nis an application under Sec.439 of the Code of Criminal Procedure,
\n1973 for regular bail by the applicant who came to be arrested in
\nconnection with  CR No. I-22 of 2010 registered with Ranpur police
\nstation, for the offence punishable under Sections 143, 147, 148,
\n149, 302 and 504 of Indian Penal Code.\n<\/p>\n
\tLearned
\nadvocate Mr. Y.J. Patel for the applicant submitted that the
\napplicant  has  not given a blow on the vital part of the body of the
\ndeceased, but he has given a blow on the left wrist of the deceased.
\nSave and except the aforesaid overt act, no other act is committed by
\nthe applicant.  Learned advocate placed reliance on the order dated
\n15.10.2010, passed by the coordinate bench of this Court in Criminal
\nMisc. Application No. 11061 of 2010, order dated 29.11.2010 passed in
\nCriminal Misc. Application No. 12430 of 2010 and the order dated
\n30.12.2010 passed by this Court in Criminal Misc. Application No.
\n14718 of 2010 and submitted that even on the ground of parity, the
\napplicant deserves to be enlarged on bail.\n<\/p>\n
\tLearned
\nAPP Mr. H.L. Jani, representing the opponent State, while opposing
\nthe bail application, submitted that considering the role attributed
\nto the applicant which is reflected in the FIR at Annexure:A to the
\napplication and the manner in which the offence is committed by the
\napplicant, no discretionary relief be granted to the applicant and
\nthe application may be dismissed.\n<\/p>\n
\tI
\nhave heard the learned advocates of both the sides at length and in
\ngreat detail. Considering the rival submissions and on perusal of the
\naverments made in the application, role attributed to the applicant
\nwhich is reflected in the FIR at Annexure:A to the application,  and
\nfurther considering the fact that other accused were granted bail by
\ncoordinate bench of this Court  vide order dated 15.10.2010 passed in
\nCriminal Misc. Application No. 11061 of 2010, order dated 29.11.2010
\npassed in Criminal Misc. Application No. 12430 of 2010 and the order
\ndated 30.12.2010 passed by this Court in Criminal Misc. Application
\nNo. 14718 of 2010, I am of the view that the applicant deserves to be
\nenlarged on bail.\n<\/p>\n
\tIn
\nthe facts and circumstances of the case, the application is allowed
\nand the applicant is ordered to be enlarged on
\nbail in connection with CR No. I-22 of 2010 registered
\nat Ranpur Police Station on executing a bond of
\nRs.10,000\/- [Rupees ten thousand only] with one surety of the like
\namount to the satisfaction of the Trial Court and subject to the
\nconditions that he shall:\n<\/p>\n
[a]\tnot
\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n
[b]\tnot
\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n
[c]\tsurrender
\nhis passport, if any, to the lower Court within a week;\n<\/p>\n
[d]\tnot
\nleave the State of Gujarat without the prior permission of the
\nSessions court concerned;\n<\/p>\n
[e]\tmark
\nhis presence at the concerned Police Station on any day of first week
\nof every English calendar month between 9.00 AM and 2.00 PM. till the
\ntrial is over;\n<\/p>\n
[f]\tfurnish
\nthe present address of his residence to the I.O. and also to the
\nCourt at the time of execution of the bond and shall not change his
\nresidence without prior permission of this Court;\n<\/p>\n
[g]\tmaintain
\nlaw and order.\n<\/p>\n
\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or to take appropriate
\naction in the matter.\n<\/p>\n
\tBail
\nbond to be executed before the lower Court having jurisdiction to try
\nthe case.\n<\/p>\n
\tAt the
\ntrial, the Trial Court shall not be influenced by the observations of
\npreliminary nature, qua the evidence at this stage, made by this
\nCourt while enlarging the applicant on bail.\n<\/p>\n
\tRule is
\nmade absolute to the aforesaid extent.\n<\/p>\n
\tDirect
