The grievance of the petitioner is that though he has been put under suspension w.e.f. 15.1.2007 in contemplation of some proceeding, the memorandum of charge has not been served on him till date and the petitioner has been unnecessarily kept under suspension. Further grievance of the petitioner is that he is also not being paid the subsistence allowance.\n<\/p>\n<p>2. At this stage, learned J.C. to S.C. (Mines) is not able to say regarding the progress in the proceeding, but it has been submitted that if the memorandum has not been served, the same shall be served without further delay. It has also been submitted that if the petitioner is not being paid the subsistence allowance arrangement shall be made to pay subsistence allowance to the petitioner.\n<\/p>\n<p>3. Considering the said submissions made by learned Counsel for the parties, this writ petition is disposed of directing the respondents to serve the memorandum charge, if any, as contemplated by the respondents while issuing the order of suspension to the petitioner. If such memorandum of charge is not served within the period of six weeks, on expiry of the said period, the petitioner&#8217;s suspension shall stand automatically revoked. However, the respondents shall pay the current subsistence allowance and arrears thereof to the petitioner since the date of his suspension within a period of four weeks from the date of receipt\/production of a copy this order.\n<\/p>\n<p>4. Let a copy of the order be handed over to learned J.C. to S.C.
