SDM(HQ).\n<\/p>\n<p>Grounds of the First Appeal:\n<\/p>\n<p>No information provided.\n<\/p>\n<p>Order of the FAA:\n<\/p>\n<p>It has been noticed that RTI application has wrongly been marked to SDM (HQ\/Baghidari). The Nodal<br \/>\nOfficer for the issues of water is BDO (South). Hence RTI application is being forwarded to BDO<br \/>\n(South) for providing information within 10 days to applicant. Appeal is disposed off accordingly.\n<\/p>\n<p>Grounds of the Second Appeal:\n<\/p>\n<p>No information provided. FAA order not followed.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant: Mr. Brijesh Kumar Chauhan;\n<\/p>\n<p>Respondent: Mr. Bhaskar Priyadarshi, Tehsildar on behalf of Mr. Pravesh Ranjan Jha, PIO &amp;<br \/>\n               SDM(Defence Colony);\n<\/p>\n<p>        The Respondent states that various officers of the department kept forwarding the RTI<br \/>\napplication mindlessly amongst themselves. He states that some information is obtained from Delhi Jal<br \/>\nBoard and the balance information had to be obtained from BDO (South). The FAA had also directed<br \/>\nBDO(South) to provide information within 10 days to the Appellant but no information was provided<br \/>\nto the Appellant. The respondent states that the person responsible for providing the information was<br \/>\nMr. A. K. Yadav, BDO(South).\n<\/p>\n<p> Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The Commission directs Mr. Bhaskar Priyadarshi to ensure that the complete<br \/>\ninformation is sent to the Appellant and the Commission before 30 June 2011.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\ndeemed PIO Mr. A. K. Yadav, BDO(South) within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it appears that the deemed PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within 30<br \/>\ndays, as per the requirement of the RTI Act. He has further refused to obey the orders of his superior<br \/>\nofficer, which raises a reasonable doubt that the denial of information may also be malafide. The First<br \/>\nAppellate Authority has clearly ordered the information to be given.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p>Mr. A. K. Yadav, BDO(South) will present himself before the Commission at the above address on<br \/>\n04 July 2011 at 2.30pm alongwith his written submissions showing cause why penalty should not be<br \/>\nimposed on him as mandated under Section 20 (1). He will also submit proof of having given the<br \/>\ninformation to the appellant.\n<\/p>\n<p>If there are other persons responsible for the delay in providing the information to the Appellant the<br \/>\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before<br \/>\nthe Commission with him.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                    Shailesh Gandhi<br \/>\n                                                                                          Information Commissioner<br \/>\n                                                                                                       16 June 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.
