Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/08\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n                W.P.C.NO.18801 OF 2008\n              ------------------------------------------\n\n              Dated       17th     August       2009\n\n\n                          JUDGMENT\n<\/pre>\n<p>            Petitioner        is      the      accused     and   first<\/p>\n<p>respondent the complainant in C.C.456\/2006 on the file<\/p>\n<p>of  Judicial    First       Class       Magistrate,        Chengannur.<\/p>\n<p>Learned Magistrate      sent the case for settlement                to<\/p>\n<p>the Adalath. Before          the Adalath a settlement was<\/p>\n<p>arrived at between the parties evidenced by Ext.P1<\/p>\n<p>agreement   whereunder          petitioner             has   to    pay<\/p>\n<p>Rs.2,50,000\/-  in    two      instalments.           Last   instalment<\/p>\n<p>being on 6\/3\/2008. But no award was passed. It is<\/p>\n<p>admitted case that Rs.1,00,000\/-                    was paid by the<\/p>\n<p>petitioner  and    received         by      first       respondent  on<\/p>\n<p>4\/2\/2008. But before the last date of payment of<\/p>\n<p>second instalment, some dispute arose between the<\/p>\n<p>parties and the matter could not be compounded. This<\/p>\n<p>petition is filed under Article 227 of Constitution of<\/p>\n<p>India for a direction to the Magistrate to permit the<\/p>\n<p>petitioner  to     deposit         the       balance       amount   of<\/p>\n<p>Rs.1,05,000\/- as provided under Ext.P1 agreement.<\/p>\n<p>WPC 18801\/08<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>           2.  Learned counsel appearing for petitioner<\/p>\n<p>and  first respondent were heard.\n<\/p>\n<p>           3.  When   learned  counsel   appearing   for<\/p>\n<p>petitioner submitted that if first respondent is not<\/p>\n<p>prepared to accept     Ext.P1 agreement, petitioner is<\/p>\n<p>prepared to proceed with the trial on condition that<\/p>\n<p>first respondent shall repay the amount of Rs.1,00,000\/-<\/p>\n<p>already received from the petitioner and petitioner<\/p>\n<p>shall be permitted to take back Rs.1,05,000\/-  deposited<\/p>\n<p>before the trial court as ordered by this court, learned<\/p>\n<p>counsel appearing for first respondent   submitted that<\/p>\n<p>first respondent\/complainant    is prepared to accept<\/p>\n<p>Ext.P1     settlement. Learned  counsel  submitted  that<\/p>\n<p>petitioner is liable to pay interest and cost for the<\/p>\n<p>amount fixed under Ext.P1. It was not acceptable to the<\/p>\n<p>counsel appearing for the petitioner.<\/p>\n<p>           5.   Learned counsel appearing for petitioner<\/p>\n<p>submitted that as petitioner is liable to pay the<\/p>\n<p>balance    of  Rs.1,05,000\/-  after   the   payment   of<\/p>\n<p>Rs.1,00,000\/- on 4\/2\/2008 on or before 6\/3\/2008 and the<\/p>\n<p>amount was deposited   only by the orders of this court,<\/p>\n<p>petitioner is prepared to pay interest for that period.<\/p>\n<p>It was also submitted that failure to pay the balance<\/p>\n<p>WPC 18801\/08<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>was not due to the fault of the petitioner   but due to<\/p>\n<p>the fault of the first respondent to receive the same.<\/p>\n<p>Learned counsel appearing for first respondent submitted<\/p>\n<p>that  if    first  respondent  is  prepared  to  deposit<\/p>\n<p>Rs.1,500\/- as interest in addition to the amount already<\/p>\n<p>deposited or   pays it directly to the counsel appearing<\/p>\n<p>for  first   respondent  before  the    trial  court,  a<\/p>\n<p>direction may be issued to dispose the case accepting<\/p>\n<p>Ext.P1 settlement.\n<\/p>\n<p>           Writ petition is disposed as agreed to by the<\/p>\n<p>parties as follows. If petitioner deposits      or pays<\/p>\n<p>Rs.1,500\/-    to  the   counsel   appearing  for   first<\/p>\n<p>respondent, learned Magistrate shall dispose the case as<\/p>\n<p>compounded under Section 147 of Negotiable Instruments<\/p>\n<p>Act treating Ext.P1 as petition to compound the offence.<\/p>\n<p>First respondent shall receive Rs.1,500\/-    tendered by<\/p>\n<p>the     petitioner  and   file  a  petition  before  the<\/p>\n<p>Magistrate      to  compound  the   offence.
