Nagaraja, P.Mahale, Advs., with<br \/>\nhim for the Respondents.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     The following Judgment of Court was delivered:<br \/>\nHANSARIA, J.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>2.   The  appellants,\twho  were  direct  recruits  to\t the<br \/>\nKarnataka  Administrative   Service  had   become  due\t for<br \/>\nconsideration for  promotion to\t the  Indian  Administrative<br \/>\nService (IAS) in the year 1982 in accordance with the Indian<br \/>\nAdministrative\t Service    (Appointment    by\t  Promotion)<br \/>\nRegulations, 1995.   They  were, however,  not so considered<br \/>\nbecause they  did not come within the zone of consideration,<br \/>\nas in  the seniority list their position was low, and as, to<br \/>\ncome within  zone of  consideration the number of persons to<br \/>\nbe considered  can be only twice, they were left out.  It is<br \/>\nnot in\tdispute that their seniority position was changed to<br \/>\ntheir advantage\t subsequently.\t It is\talso not  in dispute<br \/>\nthat had their position in the seniority list been correctly<br \/>\nreflected earlier,  they would\thave been within the zone of<br \/>\nconsideration, when the selection committee set in December,<br \/>\n1983.\n<\/p>\n<p>3.   The appellants&#8217;  case is  that they  having been denied<br \/>\nconsideration in  December,  1983  because  of\ttheir  wrong<br \/>\nplacement in  the seniority list, their promotion to the IAS<br \/>\ngot delayed,  with the consequential result that proper year<br \/>\nof allotment  was not  assigned to  them.   They, therefore,<br \/>\napproached the\tCentral Administrative\tTribunal with prayer<br \/>\nto direct  the Union  of India\tto give\t them the  order  of<br \/>\nallotment as 1979 (instead of 1982), which had been given to<br \/>\nthe persons  who were  really junior  to the appellants, but<br \/>\nhad been  shown senior\tearlier, which\tposition came  to be<br \/>\naltered subsequently.\tThis  has been\tdenied.\t Hence these<br \/>\nappeals.\n<\/p>\n<p>4.   The main  contention of  Shri Bhat,  appearing for\t the<br \/>\nUnion of India, was that despite restoration of seniority of<br \/>\nthe appellants\tthey could  not have been within the zone of<br \/>\nconsideration  when  the  selection  committee\twas  set  in<br \/>\nDecember, 1983,\t inasmuch  as  the  appellants\tcame  to  be<br \/>\nconfirmed with\teffect from  1.1.1986; and it is a confirmed<br \/>\nhand who  becomes eligible  for consideration.\tThough there<br \/>\nis no  dispute that  formal confirmation  qua the appellants<br \/>\nwas effective  from 1.1.1986, the case of the appellants, as<br \/>\nadvanced by Shri Ganguli and Shri Vaidvanathan for them, was<br \/>\nthat under  the provisions  of\tMysore\tGovernment  Servants<br \/>\n(Probation) Rules,  1957, a  probationer, after satisfactory<br \/>\ncompletion of  the period  of  probation,  becomes  due\t for<br \/>\nconfirmation; and  if for unjustifiable reasons formal order<br \/>\nof confirmation is delayed, the incumbents cannot be made to<br \/>\nsuffer.\t  The learned  counsel appearing  for the  State  of<br \/>\nKarnataka, however,  contended that  a probationer cannot be<br \/>\ntreated to  be a  confirmed employee  merely on satisfactory<br \/>\ncompletion of  probation till  an order\t of confirmation  is<br \/>\npassed.\t  This follows, according to learned counsel, from a<br \/>\ncombined reading of Rules 5 and 9 of the aforesaid Probation<br \/>\nRules.\t Despite there\tbeing force  in these contentions of<br \/>\nthe learned  counsel, we  entertain  no\t doubt\tthat  formal<br \/>\nconfirmation order  cannot be  unreasonably delayed,  as the<br \/>\ndelay causes  injury in\t those cases where confirmation is a<br \/>\npre-condition for  getting better  service condition, as was<br \/>\nin this case.\n<\/p>\n<p>5.   The facts\trelating to  the two  appellants  qua  their<br \/>\nconfirmation is\t that an  order was passed on 14th November,<br \/>\n1997 stating that the Government or Karnataka was pleased to<br \/>\ndeclare that  the officers  had satisfactorily completed the<br \/>\nperiod\tof  probation  on  14.7.1976.  Despite\tthis  formal<br \/>\nconfirmation was  ordered from\t1.1.1986. We do not find any<br \/>\ncogent reason fro this undue delay inasmuch from the Revised<br \/>\nGradation List of Karnataka Administrative Service Group &#8216;A&#8217;<br \/>\n(Junior Scale) Officers as on 1.1.1990, a copy of which is a<br \/>\npages 144 to 188 of the paper book in appeal arising out SLP<br \/>\n(C) no.\t 12129 of  1994, it  appears from  page 167 that the<br \/>\nappellants were\t confirmed against  the vacancies  which had<br \/>\noccurred  on   25.6.1962  and  4.7.1962.    There  was\tthus<br \/>\nabsolutely no  cogent reason  to confirm  them from 1.1.1986<br \/>\ninasmuch  as   they  had   satisfactorily  completed   their<br \/>\nprobationery period as early as 14.7.1976.  It is also worth<br \/>\npointing out  that the respondents.  Whose names found place<br \/>\nwithin\tthe   zone  of\t consideration\twhen  the  selection<br \/>\ncommittee was  made  in\t December,  1983,  had\tcome  to  be<br \/>\nconfirmed against  vacancies which were occurred on 5.2.1963<br \/>\nand 31.7.1976.\tThe late confirmation of the appellants can,<br \/>\ntherefore,  he\ttaken  as  illustration\t of  that  &#8220;glorious<br \/>\nuncertainty&#8221; relating  to confirmation\twhich  is  known  in<br \/>\nservice career\tand is\tamply borne out by confirmation of a<br \/>\njudicial officer as a District Judge after he had retired as<br \/>\na Supreme Court Judge.\n<\/p>\n<p>6.   In the  aforesaid premises,  we have  no doubt that the<br \/>\nappellants had\tbecome eligible\t for consideration  when the<br \/>\nselection committee set in December, 1983 and we, therefore,<br \/>\ndirect the Union of India to give that order of allotment to<br \/>\nthe appellants\twhich is  due to them by treating that their<br \/>\nselection for promotion to IAS had taken place, not pursuant<br \/>\nto the select list prepared in 1987, but in 1983.  The Union<br \/>\nof India  would pass necessary order in this regard within a<br \/>\nperiod of two months from today.\n<\/p>\n<p>7.
