Petitioner\n                                          Versus\n            The State of Jharkhand                              ...O.P.\n\n            Coram : The Hon'ble Mr. Justice Narendra Nath Tiwari\n\n            For the Petitioner        : Mr. V.K.Tiwari, Advocate\n            For the O.P.             : APP\n                                  -----\n\n 5\/28.03.2011<\/pre>\n<p>      The petitioner is an accused in the case registered for the offence under<br \/>\n            section 364A of the Indian Penal Code.\n<\/p>\n<p>                   Learned counsel for the petitioner submitted that the petitioner has been<br \/>\n            falsely implicated in the case due to previous enmity; the informant is the<br \/>\n            accused in a case earlier instituted by the father of co-accused-Alok Kumar<br \/>\n            Gupta and Vikash Sah; said co-accused-Alok Kumar Gupta @ Chunnu with<br \/>\n            almost similar allegation has been granted bail by this Court in B.A. no.7841 of<br \/>\n            2010; other co-accused-Roshan Gupta and Vikash Sah have also been granted<br \/>\n            bail by this Court in B.A. Nos.5727 of 2010 and 6875 of 2010 respectively;<br \/>\n            petitioner is in custody since June,2010.\n<\/p>\n<p>                   Learned APP opposed the prayer for bail of the petitioner and submitted<br \/>\n            that the petitioner is a resident of Chhattisgarh and there is likelihood of his<br \/>\n            absconding, if he is released on bail. However, after going through the case<br \/>\n            diary and other records, he has not disputed the other contentions of learned<br \/>\n            counsel for the petitioner.\n<\/p>\n<p>                   Regard being had to the facts and circumstances of the case, the above<br \/>\n            named petitioner is directed to be released on bail on furnishing bail bond of<br \/>\n            Rs.10,000\/-(ten thousand) with two sureties of the like amount each to the<br \/>\n            satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with<br \/>\n            Bhandaria P.S. case no.22 of 2010, corresponding to G.R. no.650 of 2010 with<br \/>\n            the condition that the bailors on behalf of the petitioner must be the local<br \/>\n            permanent residents of the place within the territorial jurisdiction of learned court<br \/>\n            below and that the petitioner shall physically appear on all the dates in the case<br \/>\n            as and when his personal appearance is required in the court below.\n<\/p>\n<p>                                                              ( Narendra Nath Tiwari, J.)<br \/>\ns.b.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Ram Sagar Singh vs State Of Jharkhand on 28 March, 2011 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.8487 of 2010 Ram Sagar Singh &#8230;.
