No.31068 of 2011\n                              Vinod Yadav, son of Dukhi Yadav\n                                             Versus\n                                     The State Of Bihar\n                                           -----------\n<\/pre>\n<p>2.   21.09.2011                  Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                                 The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Section 47(a) of the Excise Act.<\/p>\n<p>                               Considering that the petitioner is in custody since<\/p>\n<p>                  28.7.2011 and he is first offender in such a case, let the<\/p>\n<p>                  petitioner above named, be released on bail on furnishing bail<\/p>\n<p>                  bond of Rs. 5,000\/- (Five thousand) with two sureties of the like<\/p>\n<p>                  amount each or any other surety to be fixed by the court<\/p>\n<p>                  concerned to the satisfaction of Additional Chief Judicial<\/p>\n<p>                  Magistrate, Bagaha, Distt. West Champaran, in connection with<\/p>\n<p>                  Excise Case No. 01 of 2011 subject to the following conditions:<\/p>\n<p>                  (i) That one of the bailors will be a close relative of the<\/p>\n<p>                  petitioner, who will give an affidavit giving genealogy as to how<\/p>\n<p>                  he is related with the petitioner and the other shall be the father<\/p>\n<p>                  of the petitioner. The bailor will undertake to furnish information<\/p>\n<p>                  to the court about any change in the address of the petitioner.<\/p>\n<p>                  (ii) That the affidavit shall clearly state that the petitioner is not<\/p>\n<p>                  an accused in any other case of similar nature and, if he is, he<\/p>\n<p>                  shall not be released on bail. (iii) That the bailor shall also state<\/p>\n<p>                  on affidavit that he will inform the court concerned if the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        petitioner is implicated in any other case of similar nature after<\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>        on the ground of misuse. (iv) That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given<\/p>\n<p>        date and be present on date fixed for charge and if he fails to<\/p>\n<p>        do so on two given dates and delays the trial in any manner, his<\/p>\n<p>        bail will be liable to be cancelled for reasons of misuse.
