SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\nREPORTABLE<\/p>\n<p>CIVIL APPEAL NO.    2786 OF 2008<br \/>\n(Arising out of SLP (C) No. 4120 of 2007)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to order passed by a learned<br \/>\nSingle Judge of the Rajasthan High Court, Jaipur Bench.<br \/>\nRespondent No. 1 had filed application in terms of Section 24<br \/>\nof the Code of Civil Procedure, 1908 (in short the &#8216;CPC&#8217;)<br \/>\nseeking transfer of Civil Case No.41\/202\/05  titled <a href=\"\/doc\/115656\/\">Jitendra<br \/>\nSingh v. Smt. Bhanu Kumari &amp; Ors.<\/a> pending before the<br \/>\nDistrict and Sessions Judge, Alwar, Rajasthan  to some other<br \/>\nCourt.  By the impugned order the High Court directed that<br \/>\nthe suit in question to be transferred from the Court of<br \/>\nAdditional District Judge No.2 Alwar to the Court of District<br \/>\nJudge, Jaipur City.\n<\/p>\n<p>3.\tLearned counsel for the appellant submitted that this is<br \/>\nyet another attempt to deny the appellant of his legitimate<br \/>\nentitlement. It is pointed out that in an earlier petition<br \/>\n(Transfer Petition (C) No.1105 of 2005 titled Maharaja Sewai<br \/>\nTej Singh v. Jitender Singh &amp; Ors.) this court declined to<br \/>\naccept the prayer for transfer. But keeping in view the age and<br \/>\nthe state of health of the petitioner in that case, directed<br \/>\nappointment of a Guardian ad litem.  It is pointed out that in<br \/>\nfact as has been noted by the High Court, a learned counsel<br \/>\nhas been appointed as guardian ad litem. It is the stand of the<br \/>\nappellant that the reason which weighed with the High Court<br \/>\nto direct transfer is really of no consequence, more particularly<br \/>\nin view of what has been stated by this Court in the earlier<br \/>\nTransfer Petition.\n<\/p>\n<p>4.\tLearned counsel for the respondent on the other hand<br \/>\nsubmitted that taking into consideration the serious nature of<br \/>\nthe allegations made the High Court has rightly directed<br \/>\ntransfer.\n<\/p>\n<p>5.\tThe High Court&#8217;s conclusions based on the basis of<br \/>\nwhich order of transfer has been made, read as follows:\n<\/p>\n<p>&#8220;Having scanned the record, I noticed<br \/>\nthat the suit was transferred by the District<br \/>\nJudge to the Court of Additional District Judge<br \/>\nNo.2, Alwar in the month of December, 2005.<br \/>\nThe petitioner although filed instant petition in<br \/>\nthis Court on August 17, 2006, did not<br \/>\nmention this fact that the suit stood<br \/>\ntransferred from the Court of District Judge<br \/>\nAlwar.  The Petitioner stated in para 3 of the<br \/>\npetition that the respondent Jitendra Pratap<br \/>\nSingh is influential person and MLA of Alwar<br \/>\nCity and he has created such a situation that<br \/>\nthere is astrong likelihood of the matter<br \/>\npending before the District Judge being<br \/>\ndecided ex-parte against the petitioner and<br \/>\nother members.  This apprehension of<br \/>\npetitioner, in my opinion, is baseless.  The<br \/>\nCourts are not influenced by politicians and<br \/>\ninfluential persons.  The petitioner should<br \/>\nrepose full confidence upon the court of<br \/>\njustice.  If ex-parte order was passed by the<br \/>\nlearned District Judge and the petitioner was<br \/>\naggrieved by it, she ought to have assailed it<br \/>\nlegally.  Passing of ex-parte order by the<br \/>\nPresiding Officer of the court cannot be a<br \/>\nreasonable ground for transferring the case.\n<\/p>\n<p>But looking to the fact that on January 8,<br \/>\n2006 respondent Jitendra Singh lodged FIR<br \/>\nNo. 19 of 2006 with the Police Station Kotwali<br \/>\nAlwar against the petitioner and respondents<br \/>\nAmar Raj Pal and Jaswant Singh and case<br \/>\nunder Sections 420, 467, 468 and 471 IPC has<br \/>\nbeen registered against them and considering<br \/>\nthe overall view of the nature of the case and<br \/>\nconvenience of the parties and in the interest<br \/>\nof justice, it would be just and reasonable to<br \/>\ndirect transfer of suit from the court of<br \/>\nAdditional District Judge No. 2 Alwar to the<br \/>\nCourt of District Judge, Jaipur City.&#8221;\n<\/p>\n<p>6.\tIt appears that the High Court referred to the fact that<br \/>\nthe criminal proceedings have been instituted against the<br \/>\nappellant.  It is pointed out by learned counsel for the<br \/>\nappellant that the filing of the FIR is really of no consequence.<br \/>\nIn respect of the plaint averments, in his reply before the High<br \/>\nCourt to the transfer petition it was inter alia stated as follows:\n<\/p>\n<p>&#8220;That the contents of sub para (xviii) are<br \/>\nnot admitted in the manner stated.  The<br \/>\nanswering respondent lodged the FIR<br \/>\n(Annexure-9) on the facts constituting the<br \/>\noffences under different Sections of the Penal<br \/>\nCode committed by the accused persons<br \/>\nnamed therein. It is denied that the<br \/>\nrespondent No.1 filed the FIR to exert pressure<br \/>\non the petitioner and to pressurise the lawyer<br \/>\nseeking to represent the petitioner.   The<br \/>\nallegations are baseless and wholly without<br \/>\nsubstance.  It is humbly submitted that the<br \/>\nrespondent No. 2 acted hand-in gloves with the<br \/>\npetitioner Smt. Bhanu Kumari and her brother<br \/>\nYashwant Singh, got a purported power of<br \/>\nattorney prepared in his favour and acting<br \/>\nupon that the respondent No.2 negotiated for<br \/>\n<span class=\"hidden_text\">sale of the property of respondent No. 4 <\/span><br \/>\nMaharaja Sawai Tej Singh Ji for a<br \/>\nconsideration of Rs.77,30,328\/-. The<br \/>\nagreement entered into on 18.4.2005 besides<br \/>\nbeing void was for inadequate consideration.<br \/>\nThe respondent No.2 as attorney received the<br \/>\npart payment of the consideration in cash and<br \/>\nby cheque in his own name.  The petitioner<br \/>\nand the respondent Nos. 2&amp;3 to make<br \/>\nwrongful gain colluded and connived with each<br \/>\nother to make the respondent No.4 sign<br \/>\ndocuments or papers who was a person under<br \/>\nincapacity, incapable of understanding the<br \/>\ncontents to which he was made to sign and\/or<br \/>\nthat his signature was forged.  The respondent<br \/>\nNo.2 Shri Amar Raj Lall, Advocate acted<br \/>\nagainst professional ethics and involved<br \/>\nhimself in criminal conspiracy.  True and<br \/>\ncorrect copy of the power of attorney,<br \/>\nagreement for sale dated 18.4.2005 and the<br \/>\nreceipt dated 25.4.2005 are enclosed herewith<br \/>\nand marked as Annexure R-1\/4, R-1\/5 and R-<br \/>\n1\/6 respectively.  A true and correct copy of<br \/>\nthe affidavit of respondent No.2 Amar Raj Lall,<br \/>\nfiled in transfer petition before the Hon&#8217;ble<br \/>\nApex Court is filed herewith and marked as<br \/>\nAnnexure R-1\/7.&#8221;\n<\/p>\n<p>7.\tThough grievance is made by the respondents that no<br \/>\ncompetent lawyer at Alwar is willing to represent them, it is of<br \/>\nsignificance to note that the suit has been filed by two<br \/>\npersons.  Respondents 2 &amp; 3 are represented by experienced<br \/>\nlawyers and they have been representing the respondents for<br \/>\nvery long period.  The parameters for exercise in Sections 24 &amp;<br \/>\n25 have been laid down by this Court in several cases. Earlier<br \/>\nthan Transfer Petition (Civil) No.1105 of 2005 was disposed of<br \/>\nwith certain directions.\n<\/p>\n<p>8.\tThe reasons which weighed with the High Court to direct<br \/>\ntransfer do not appear to be germane warranting an order of<br \/>\ntransfer.\n<\/p>\n<p>9.\tThe purpose of Section 24 CPC is merely to confer on the<br \/>\nCourt a discretionary power.  A court acting under Section 24<br \/>\nCPC may or may not in its judicial discretion transfer a<br \/>\nparticular case. Section 24 does not prescribe any ground for<br \/>\nordering the transfer of a case.  In certain cases it may be<br \/>\nordered suo motu and it may be done for administrative<br \/>\nreasons. But when an application for transfer is made by a<br \/>\nparty, the court is required to issue notice to the other side<br \/>\nand hear the party before directing transfer.  To put it<br \/>\ndifferently, the Court must act judicially in ordering a transfer<br \/>\non the application of a party. In the instant case the reason<br \/>\nwhich has weighed with the High Court for directing transfer<br \/>\ndoes not really make out a case for transfer.\n<\/p>\n<p>10.\tAccordingly the impugned order of the High Court is set<br \/>\naside.\n<\/p>\n<p>11.\tAppeal is allowed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Jitendra Singh vs Bhanu Kumari &amp; Ors on 11 April, 2008 Author: .
