3    28-09-2011             Feeling aggrieved by the order dated 2nd May 2011 made by
\n                     the learned single Judge in above C.W.J.C. No. 13925 of 2010
\n                     arising from Title Suit No. 15 of 1996 pending before the Court of
\n                     Munsif, Biharsharif, the writ petitioner has preferred this Appeal
\n                     under Clause 10 of the Letters Patent.\n<\/p>\n
                            The impugned order having been made in exercise of power
\n                     of superintendence conferred by Article 227 of the Constitution
\n                     the Appeal under Clause 10 of the Letters Patent should not lie.
\n                     Besides, in our view the aforesaid writ petition has been filed in
\n                     lieu of revision application under Section 115 C.P.C. as it stood
\n                     before amendment by Act No. 46 of 1999. The entertainment of
\n                     Appeal under Clause 10 of the Letters Patent against such order
\n                     would defeat the purpose of the amendment of Section 115 C.P.C.
\n                     Therefore, in our view the letters patent Appeal is not
\n                     maintainable.\n<\/p>\n
                            Appeal is accordingly dismissed.\n<\/p>\n
