OF JANAKBHAI J PATEL &amp; 4 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR RG\nCHAUDHARY for Appellant(s). \nMR\nMB GANDHI for\nRespondent(s) : 1, \nNone for Respondent(s) : 2 -\n5. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/01\/2011\n \n\nCOMMON\nORAL ORDER<\/pre>\n<p>By<br \/>\n\tway of present Appeal From Order, the appellants have inter alia<br \/>\n\tprayed for quashing and setting aside the impugned order dated 30th<br \/>\n\tJuly 2010 passed by the learned Judge, City Civil Court, Ahmedabad,<br \/>\n\tbelow Exhs.6 and 7 in Civil Suit No.901 of 2009.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocates for the respective parties.\n<\/p>\n<p>Without<br \/>\n\tentering into merits of the matter and having<br \/>\n\tconsidered the contentions raised by the learned advocates for the<br \/>\n\trespective parties, averments made in the Appeal From Order and the<br \/>\n\tdocumentary evidence produced on record, it transpires that<br \/>\n\tthe trial Court has wrongly rejected the said applications only on<br \/>\n\tthe ground of suppression of material facts by the appellants as<br \/>\n\twell as on the principle of Res Judicata. In fact and in reality,<br \/>\n\tprima facie the First<br \/>\n\tAppeal in question i.e. First<br \/>\n\tAppeal No.1749 of 2001 is pending before this Court. Hence,<br \/>\n\tthe impugned order passed by the trial Court is required to be<br \/>\n\tquashed and set aside since the trial Court has not decided the said<br \/>\n\tapplications on merits but only on technical grounds they have been<br \/>\n\trejected.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, present petition is hereby partly allowed. The<br \/>\n\timpugned order passed by the trial Court is hereby quashed and set<br \/>\n\taside since the Notice of Motion is not decided on merits. The<br \/>\n\tmatter is remanded to the trial Court.
