1.The petitioners in these writ petitions applied for being<\/p>\n
  considered for the post of Lecturer in Malayalam in the<\/p>\n
  Training   Colleges       under       the         Collegiate  Education<\/p>\n
  Department of the State Government in terms of Ext.P1<\/p>\n
  notification of the Public Service Commission.<\/p>\n
2.The entitlement of the petitioner in W.P(C).14969\/04 stands<\/p>\n
  rejected by the PSC on the ground that she did not have the<\/p>\n
  requisite experience in as much as her experience as<\/p>\n
  primary departmental teacher in a school is not an<\/p>\n
  experience entitled to be reckoned.\n<\/p>\n<\/p>\n
3.W.P(C).21327\/03 is filed by one of the candidates<\/p>\n
  challenging the inclusion of candidates who have not passed<\/p>\n
  the National Eligibility Test (NET) in Education, also in the<\/p>\n
WPC.21327\/03 & 14969\/04<\/p>\n
                                2<\/span><\/p>\n
  field of choice, for selection and appointment in terms of<\/p>\n
  Ext.P1 notification. In opposition to W.P(C).21327\/03, the<\/p>\n
  PSC has placed on record a counter affidavit, taking the<\/p>\n
  specific stand that the candidate ought to have NET<\/p>\n
  qualification in the concerned subject and also in Education<\/p>\n
  for being considered for appointment to the Training<\/p>\n
  Colleges.\n<\/p>\n<\/p>\n
4.The different posts notified as per Ext.P1 relating to the<\/p>\n
  Training Colleges are posts in the Faculty of Education and<\/p>\n
  therefore, the insistence of the UGC, which have been<\/p>\n
  agreed to by the PSC in its counter affidavit, that a<\/p>\n
  candidate has to possess NET in Education and in the<\/p>\n
  concerned subject stands.\n<\/p>\n<\/p>\n
5.When these writ petitions were heard earlier on 3.10.2007,<\/p>\n
  the PSC had placed on record that a candidate shall possess<\/p>\n
  NET in Education as well as in the concerned subject.<\/p>\n
  Accordingly, it was declared that the candidates for selection<\/p>\n
WPC.21327\/03 & 14969\/04<\/p>\n
                                 3<\/span><\/p>\n
  and appointment to the Faculty of Education in the Training<\/p>\n
  Colleges in different departments have to possess NET<\/p>\n
  qualification in Education and also NET qualification in the<\/p>\n
  concerned subject.\n<\/p>\n<\/p>\n
6.Thereafter,        by  common    order     dated    19.2.2008,<\/p>\n
  R.P.Nos.1051\/07 and 1126\/07 were ordered vacating the<\/p>\n
  aforesaid common judgment except to the extent of the<\/p>\n
  findings which were protected by that order.             While<\/p>\n
  considering       those two  review   petitions,  this   Court<\/p>\n
  specifically stated that the issue that arises for decision<\/p>\n
  ultimately, is as to whether a candidate, for being considered<\/p>\n
  for appointment as a Lecturer in Malayalam in a Training<\/p>\n
  College in the State of Kerala, requires NET qualification in<\/p>\n
  Education and also NET in Malayalam.           Another review<\/p>\n
  petition which escaped from being disposed of then, viz.,<\/p>\n
  R.P.No.1119\/07, has been ordered by me today, adopting the<\/p>\n
  common order in R.P.Nos.1051\/07 and 1126\/07. The writ<\/p>\n
  petitioner in W.P(C).14969\/04 (Retna Bhai’s case) contends<\/p>\n
WPC.21327\/03 & 14969\/04<\/p>\n
                                   4<\/span><\/p>\n
  that the prescription is only optional, in the sense that NET<\/p>\n
  qualification may be either in Malayalam or in Education.<\/p>\n
  The petitioner in W.P(C).21327\/03, Deneshan, takes the<\/p>\n
  stand that NET qualification ought to be in Education even if<\/p>\n
  the applicant has NET qualification in Malayalam.           The<\/p>\n
  question therefore is as to whether NET qualification in<\/p>\n
  Education is compulsory for the purpose of being considered<\/p>\n
  for appointment as Lecturer in Malayalam in a Training<\/p>\n
  College or is it sufficient if NET qualification is obtained<\/p>\n
  either in Malayalam or in Education.\n<\/p>\n<\/p>\n
7.Following the order dated 19.2.2008 on R.P.Nos. 1051\/07<\/p>\n
  and 1126\/07, different other materials were placed on<\/p>\n
  record, on the basis of which, the PSC has taken a stand that<\/p>\n
  its earlier plea was an error and it would be sufficient if NET<\/p>\n
  qualification is obtained either in Malayalam or in<\/p>\n
  Education.       The qualifications prescribed for the post of<\/p>\n
  Lecturer in Training Colleges, as stated in the short counter<\/p>\n
WPC.21327\/03 & 14969\/04<\/p>\n
                                 5<\/span><\/p>\n
 affidavit filed by the PSC, following directions of this Court,<\/p>\n
 are as follows:\n<\/p>\n<\/p>\n
     “(i) Master Degree in the concerned subject or<\/p>\n
     discipline with at least 55% marks or its equivalent and<\/p>\n
     good academic records.\n<\/p><\/blockquote>\n
<\/blockquote>\n
     (ii) M.Ed degree with knowledge of special methods of<\/p>\n
     teaching the subjects.\n<\/p><\/blockquote>\n
<\/blockquote>\n
     (iii) Three years teaching experience in Schools or<\/p>\n
     Colleges after acquiring the personnel qualifications.<\/p>\n<\/blockquote>\n
     (iv) Must have passed a comprehensive test specially<\/p>\n
     conducted for the purpose by UGC or any agency duly<\/p>\n
     constituted by the State Govt. in this behalf.<\/p>\n<\/blockquote>\n
             When qualifications are equal preference shall be<\/p>\n
     given to candidates who possess adequate knowledge<\/p>\n
     in Malayalam. Candidates need to possess either NET<\/p>\n
     in Education or NET in the concerned subject<\/p>\n
     (Malayalam) to be eligible for selection in Training<\/p>\n
     Colleges”.\n<\/p><\/blockquote>\n

                                 6<\/span><\/p>\n
 The specific plea of the PSC is that candidates need to<\/p>\n
 possess NET in Education or NET in the subject concerned<\/p>\n
 to be eligible for selection to Training Colleges.         The<\/p>\n
 materials placed by the UGC is also not decisive to conclude<\/p>\n
 that an aspirant should possess NET qualification in<\/p>\n
 Education and NET in the concerned subject for being<\/p>\n
 eligible for selection as a Lecturer in a Training College.<\/p>\n
 In view of what is stated above, W.P(C).21327\/03 is<\/p>\n
 dismissed.        W.P(C).14969\/04 is allowed as prayed for.<\/p>\n
 Having regard to the issues involved, the parties are<\/p>\n
 directed to bear their respective costs.<\/p>\n
