Mehta appearing on behalf of applicant.<br \/>\n\tOn last occasion, on 29.11.2010, matter was adjourned because<br \/>\n\tlearned advocate Mr.R.B.Joshi has not remained present, even though,<br \/>\n\trequest was made by learned advocate Mr.Mehta that learned advocate<br \/>\n\tMr.Joshi is coming from Bhavnagar, therefore, matter was adjourned<br \/>\n\twith a clarification that if learned advocate Mr.Joshi will not<br \/>\n\tremain present on 02.12.2010, then this Court will proceed further<br \/>\n\tin absence of learned advcoate Mr.Joshi.\n<\/p>\n<p>Today,<br \/>\n\tlearned advocate Mr.Joshi has not remained present, therefore, I<br \/>\n\thave considered submissions made by learned advocate Mr.Mehta and<br \/>\n\talso perused judgment and decree passed by Courts below. According<br \/>\n\tto my opinion question involved and raised in present application,<br \/>\n\trequires detailed examination.
