Before<\/p>\n<p>formation of the petitioner company, the activity in<\/p>\n<p>question was being carried out by the Department of<\/p>\n<p>Telecommunications, Government                      of India.    The<\/p>\n<p>petitioner is now occupying properties and buildings<\/p>\n<p>owned by the Department of Telecommunications (DOT)<\/p>\n<p>used for providing such facilities.                  According to the<\/p>\n<p>petitioner none of the assets of the DOT has been<\/p>\n<p>transferred into the name of the petitioner.                  Hence,<\/p>\n<p>inspite of occupation of various buildings by the<\/p>\n<p>petitioner, ownership of such buildings still vests with<\/p>\n<p>W.P.(C).29188\/10-             -2-\n<\/p>\n<p>the Government of India, more precisely with the President<\/p>\n<p>of India.\n<\/p>\n<p>      2.    The issue involved in this writ petition pertains to<\/p>\n<p>assessment of Building Tax under the provisions of the<\/p>\n<p>Kerala Building Tax Act 1975 (KBT Act) with respect to a<\/p>\n<p>building occupied by the petitioner situated at Kondotty in<\/p>\n<p>Malappuram District, in which the Telephone Exchange is<\/p>\n<p>housed. The ground floor of the building in question was<\/p>\n<p>constructed by the DOT and no assessment was made in<\/p>\n<p>view of the exemption provided under Article 285 (1) of the<\/p>\n<p>Constitution of India and in view of the exemption provided<\/p>\n<p>under Section 3(1)(a) of the KBT Act. Later, the petitioner<\/p>\n<p>had constructed two more floors on the existing building,<\/p>\n<p>construction of which was completed on 15.11.2000 and<\/p>\n<p>28.12.2001 respectively.\n<\/p>\n<p>      3.    On the basis of return filed in Form No:II as<\/p>\n<p>provided under the relevant Rules, the 1st respondent<\/p>\n<p>finalised the assessment as per Ext.P1 order, without giving<\/p>\n<p>exemption for the ground portion owned by the DOT.<\/p>\n<p>Ext.P1 order was challenged by the petitioner before the 2nd<\/p>\n<p>W.P.(C).29188\/10-              -3-\n<\/p>\n<p>respondent, the appellate authority. But the appeal was<\/p>\n<p>dismissed holding that the petitioner being a company the<\/p>\n<p>exemption under Section (3)(1)(a) of the KBT Act is not<\/p>\n<p>applicable.\n<\/p>\n<p>      4.    According to the petitioner, in Ext.P2 order, the<\/p>\n<p>2nd respondent had omitted to take note of the contention<\/p>\n<p>that, the ground floor of the building was not conveyed to<\/p>\n<p>the petitioner and that the Central Government still<\/p>\n<p>continues to be its owner, and the same is liable to be<\/p>\n<p>exempted. Aggrieved by Ext.P2 order, the petitioner filed a<\/p>\n<p>rectification application as evidenced from Ext.P3.        But<\/p>\n<p>without considering pendency of such application, revenue<\/p>\n<p>recovery steps were initiated on issuing Ext.P4 and P5<\/p>\n<p>demand notices.      Hence the actions in this regard are<\/p>\n<p>challenged in this writ petition.\n<\/p>\n<p>      5.    Contention of the petitioner is that the assessment<\/p>\n<p>ought to have been restricted for the plinth area covered by<\/p>\n<p>the first and second floors of the building. It is noticed that<\/p>\n<p>while finalising the assessment the entire plinth area of all<\/p>\n<p>the 3 floors were taken together and the entire building was<\/p>\n<p>W.P.(C).29188\/10-             -4-\n<\/p>\n<p>assessed as a single unit. If it is evident that the ground<\/p>\n<p>floor remained completed prior to occupation by the<\/p>\n<p>petitioner and it was constructed by DOT. The said building<\/p>\n<p>(the ground floor) is liable to be exempted from payment of<\/p>\n<p>tax since it was owned by the Government of India as on the<\/p>\n<p>date of completion, which is the taxable event.<\/p>\n<p>      6.    But the question arises as to what should be the<\/p>\n<p>procedure to be adopted for completion of assessment with<\/p>\n<p>respect to the additional constructions effected. Going by<\/p>\n<p>Section 5(4) of the Kerala Building Tax Act and as settled<\/p>\n<p>through various precedents of this court, the proper<\/p>\n<p>procedure is to reckon the entire plinth area for the purpose<\/p>\n<p>of assessment and to give credit to the tax amount already<\/p>\n<p>paid. But the procedure as contemplated under Section 5<\/p>\n<p>(4) will be applicable only in a case where the existing<\/p>\n<p>building was completed after the &#8216;appointed day&#8217;. Needless<\/p>\n<p>to observe that if the ground floor is completed prior to the<\/p>\n<p>&#8216;appointed day&#8217;, then the assessment can be completed only<\/p>\n<p>with respect to the first floor and second floor, as<\/p>\n<p>contemplated under Section 5(3).\n<\/p>\n<p>W.P.(C).29188\/10-              -5-\n<\/p>\n<\/p>\n<p>      7.    On the other hand, if it is found that the ground<\/p>\n<p>floor was completed after the appointed day, then the<\/p>\n<p>procedure provided under Section 5(4) need be followed.<\/p>\n<p>Even assuming that the ground floor portion stood<\/p>\n<p>transferred or assigned into the name of the petitioner,<\/p>\n<p>even then the petitioner is not liable for payment of building<\/p>\n<p>tax with respect to the ground floor, because they were not<\/p>\n<p>the owners at the time of completion of the ground floor,<\/p>\n<p>which is the point of time of the taxable event.<\/p>\n<p>      8.    Learned counsel for the petitioner raised an<\/p>\n<p>argument that Section 5(4) could not be adopted, since<\/p>\n<p>ownership of the building stands distinctly with respect to<\/p>\n<p>different floors, completed at different time.      But it is<\/p>\n<p>evident that the plinth area of the building was<\/p>\n<p>subsequently      increased  by    new    extension\/additional<\/p>\n<p>construction and in such case Section 5(4) will be<\/p>\n<p>applicable, despite the ownership of distinct area remains<\/p>\n<p>with different persons. Therefore, I am of the considered<\/p>\n<p>opinion that the assessment need be finalised adopting the<\/p>\n<p>procedure contemplated under Section 5(4) itself, if the<\/p>\n<p>W.P.(C).29188\/10-              -6-\n<\/p>\n<p>authority is convinced that the ground floor was completed<\/p>\n<p>after the appointed day.\n<\/p>\n<p>      9.    The next question arising for decision is as to<\/p>\n<p>whether the petitioner is entitled for any credit, in case the<\/p>\n<p>assessment is to be completed under Section 5(4).          As<\/p>\n<p>observed above, there was no tax collected with respect to<\/p>\n<p>the ground floor, since it was exempted from payment. But<\/p>\n<p>there is no justification for denying benefit of credit to the<\/p>\n<p>extent of tax payable to the petitioner, merely because the<\/p>\n<p>owner of the existing portion had availed statutory<\/p>\n<p>exemption. The wording in Section 5(4), &#8220;already levied<\/p>\n<p>and collected&#8221; should be given a constructive interpretation<\/p>\n<p>in such a situation, so as to include in its ambit and purport<\/p>\n<p>to give credit also to, tax leviable but exempted. It is more<\/p>\n<p>so because, merely because the owner of the existing<\/p>\n<p>portion was entitled for exemption from paying tax, the<\/p>\n<p>petitioner who had constructed only the additional plinth<\/p>\n<p>area could not be mulcted with liability for payment of tax<\/p>\n<p>to the existing portion also.\n<\/p>\n<p>      10. The learned counsel for the petitioner had<\/p>\n<p>W.P.(C).29188\/10-             -7-\n<\/p>\n<p>brought to my notice a decision of this court in WP(C).<\/p>\n<p>8449\/05 and connected cases wherein it is held that as far<\/p>\n<p>as the additions or modifications of a building effected by<\/p>\n<p>the BSNL, Section 5(3) and 5(4) of the Act can be invoked<\/p>\n<p>and the building can be assessed as and when additions and<\/p>\n<p>modifications are made by the petitioner which attract<\/p>\n<p>building tax.\n<\/p>\n<p>      11. Under the above narrated circumstances, the writ<\/p>\n<p>petition is allowed and Ext.P2 order is hereby quashed. The<\/p>\n<p>2nd respondent is directed to take back the appeal and to<\/p>\n<p>dispose of the same afresh, taking note of the observations<\/p>\n<p>contained herein above.\n<\/p>\n<p>      12.
