Raval for the respondent no.1-State of<br \/>\n\tGujarat and learned counsel, Mr.Mrudul Barot for<br \/>\n\tthe respondent no.2-original complainant waive service of notice of<br \/>\n\trule.\n<\/p>\n<p>The<br \/>\n\tpresent application has been filed by the applicants under Section<br \/>\n\t482 of the Criminal Procedure<br \/>\n\tCode, 1973 for the prayer to quash and set aside FIR being<br \/>\n\tC.R.No.I-107\/2011 registered with Isanpura Police Station, District<br \/>\n\t: Ahmedabad on the grounds mentioned in the application.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel, Mr.Brijesh Limbachia for the applicants, learned<br \/>\n\tA.P.P., Mr.K.P. Raval for the respondent no.1-State of Gujarat and<br \/>\n\tlearned counsel, Mr.Mrudul Barot for the respondent no.2-original<br \/>\n\tcomplainant.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Limbachia for the applicants and learned counsel,<br \/>\n\tMr.Barot for the respondent no.2 have stated that the parties have<br \/>\n\tamicably settled the dispute, for which, affidavit of the<br \/>\n\tcomplainant-respondent no.2 herein is placed on record stating that<br \/>\n\tit was only with regard to trespass regarding the right of passing<br \/>\n\tthrough the land, which has been amicably settled.\n<\/p>\n<p>In<br \/>\n\tview of the rival submissions and having regard to the affidavit<br \/>\n\tfiled by the complainant and also considering the nature and alleged<br \/>\n\toffence as well as guidelines laid down by the Hon&#8217;ble Apex Court in<br \/>\n\ta judgment in case of Madan Mohan Abbot V\/s State of Punjab<br \/>\n\treported in (2008) 4 SCC 582, wherein it has been observed<br \/>\n\tthat the pragmatic approach with ground of realities should be<br \/>\n\tadopted, the present application deserves to be allowed.\n<\/p>\n<p>In<br \/>\n\tthe circumstances, the present application stands allowed in terms<br \/>\n\tof Para No.7(A). The impugned FIR being C.R.No.I-107\/2011, for the<br \/>\n\toffences punishable under Sections 452, 441, 453, 447, 506(1),<br \/>\n\t294(b) and 114 of the Indian Penal Code registered with Isanpur<br \/>\n\tPolice Station, District : Ahmedabad dated 27.04.2011 is hereby<br \/>\n\tquashed and set aside.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
