DABHI, APP, for the Respondent State of\nGujarat \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>\t\tRule.\n<\/p>\n<p>Mr. Dabhi, learned APP, waives service of rule on behalf of the<br \/>\nrespondent State of Gujarat.\n<\/p>\n<p>2.\t\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing.\n<\/p>\n<p>3.\t\tBy<br \/>\nfiling instant application, the applicant-convict person has prayed<br \/>\nfor suspension of his sentence and to release him on regular bail<br \/>\nduring the pendency and final hearing of the above numbered Criminal<br \/>\nAppeal. Alternatively, it is also prayed to  pass appropriate orders<br \/>\nfor early hearing of the above numbered Criminal Appeal since the<br \/>\napplicant-convict person is in jail for more than five years as<br \/>\nagainst the sentence of 10 years awarded to him.\n<\/p>\n<p>4.\t\tAt<br \/>\nthe time of hearing of this application Mr. Yagnik, learned advocate<br \/>\nfor Nanavaty Advocates for the applicant does not press the prayer<br \/>\nfor suspension of sentence and to release the applicant-convict<br \/>\nperson on regular bail during the pendency and final hearing of the<br \/>\nabove numbered Criminal Appeal. However, he urges that since the<br \/>\npaper book has been received, the hearing of the above numbered<br \/>\nCriminal Appeal may be expedited by listing the appeal on final<br \/>\nhearing board.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of this, the prayer for suspension of sentence and to release<br \/>\nthe applicant-convict person  on regular bail during the pendency and<br \/>\nfinal hearing of the above numbered Criminal Appeal does not assume<br \/>\nsurvival value.\n<\/p>\n<p>6.\t\tThe<br \/>\nRegistry is directed to notify the above numbered Criminal Appeal on<br \/>\nfinal hearing board in seriatim.\n<\/p>\n<p>7.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>  (A.M.
