Justice J.M.JAMES\n\n Dated :12\/09\/2006\n\n O R D E R\n                            J.M.JAMES, J.\n\n                               --------------\n\n                           B.A. 5371\/2006\n\n                            ------------------\n\n DATED THIS THE 12TH DAY OF SEPTEMBER, 2006\n\n\n\n\n                              O R D E R\n<\/pre>\n<p>               The   petitioner   is   accused   of   the   offence<\/p>\n<p>punishable   under   Section   55(g)   of   the   Abkari   Act   in<\/p>\n<p>C.R.No.2\/2005   of   Konni   Excise   Range.     The   prosecution<\/p>\n<p>alleges that the petitioner was found in  illegal possession<\/p>\n<p>of   445   liters   of  wash   on   14.2.2005.     But   he  could   not   be<\/p>\n<p>arrested as he ran away and escaped.     This is denied by<\/p>\n<p>the counsel  for  the  petitioner.     However,  the  prosecution<\/p>\n<p>submitted   that   there   is   also   another   case   registered<\/p>\n<p>against the petitioner,  in violation of the provisions of the<\/p>\n<p>Abkari Act.\n<\/p>\n<\/p>\n<p>         2.    After   hearing   both   sides   and   considering   the<\/p>\n<p>facts on record,  I direct the petitioner to surrender before<\/p>\n<p>the        Inspector   of   Excise   Range,   Konni,               who   is<\/p>\n<p>investigating   C.R.No.2\/2005   of   that   Excise   Range,   on<\/p>\n<p>19.9.2006   between   9.30   a.m   and   10.00   a.m.     The<\/p>\n<p>Investigating   Officer   shall   interrogate   the   petitioner   and<\/p>\n<p>B.A.5371\/2006<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>thereafter, produce him before the Court below,   before<\/p>\n<p>4.30 p.m on the same day itself.\n<\/p>\n<\/p>\n<p>        3.
