The appellant herein (now<br \/>\ndeceased) had also preferred suit being Civil Suit No.4920\/1985<br \/>\nagainst the respondents herein seeking injunction by way of<br \/>\nrestraining the defendants from interfering with his use and<br \/>\noccupation of the suit premises. After hearing both the sides, the<br \/>\nCourt below decreed Civil Suit No.3494\/1985 in favour of the<br \/>\nrespondents herein and rejected Civil Suit No.4920\/1985 preferred by<br \/>\nthe appellant herein. Being aggrieved by the same, the appellant has<br \/>\npreferred the present appeals.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for both the sides and perused the documents on<br \/>\nrecord. After appreciating the evidence on record, the Court below<br \/>\nfound that the rear doors in the suit premises had been subsequently<br \/>\nerected. The Court below found that the defendants, the appellants<br \/>\nherein, were attempting to make encroachment over the disputed land<br \/>\nand therefore, it was necessary that the plaintiffs are permitted to<br \/>\nerect a compound wall considering the fact that a major chunk of the<br \/>\narea of the shops of the defendants would be taken away in road<br \/>\nwidening. Considering the above factual aspects, I am of the view<br \/>\nthat the Court below has rightly decreed Civil Suit No.3494\/1985 in<br \/>\nfavour of the respondents-plaintiffs and rejected Civil Suit<br \/>\nNo.4920\/1985 preferred by the deceased appellant. I am in complete<br \/>\nagreement with the reasonings given by and the findings recorded by<br \/>\nthe Court below in the impugned judgment and decree and hence, find<br \/>\nno reasons to interfere in these appeals.\n<\/p>\n<p>4.\tFor<br \/>\nthe foregoing reasons, both the appeals are rejected.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
