Singh\nRespondent Counsel :- C.S.C.,Amit Saxena,P.N.Saxena,Pradeep\nVerma\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>Jan Priya Audyogik Junior High School Society, Kanpur and<br \/>\nKrishna Gopal Verma claiming himself to be the President and the<br \/>\nlife member of the Society have filed this petition for setting aside<br \/>\nthe order dated 7th January, 2009 passed by the District Inspector<br \/>\nof Schools, Kanpur by which he has, pursuant to the directions<br \/>\nissued by the Regional Level Committee, held the election and<br \/>\nattested the signatures of Madan Gopal Verma as the Manager of<br \/>\nthe Committee of Management of the Institution.\n<\/p>\n<p>An application supported by affidavit of Madan Gopal Verma,<br \/>\nrespondent No.5 has been filed with the following prayer:\n<\/p>\n<p>&#8220;It is therefore, most respectfully prayed that this Hon&#8217;ble Court<br \/>\nmay kindly be pleaded to allow the writ petition, quash the<br \/>\nelection dated 28.12.2008 and its recognition dated 07.01.2009<br \/>\nand the District Inspector of Schools be directed to hold fresh<br \/>\nelection of the committee of management himself or through his<br \/>\nnominee from the indisputed list of members of the General Body<br \/>\nwho had participated in the indisputed election held on<br \/>\n28.12.2003 within a period fixed by this Hon&#8217;ble Court. It is<br \/>\nfurther prayed that this Hon&#8217;ble Court may direct the Joint<br \/>\nDirector of Education , Kanpur to appoint a Prabandh Sanchalak<br \/>\nfor managing the affairs of the institution till the new committee<br \/>\ntakes over the charge; or to pass such other and further order,<br \/>\nwhich this Hon&#8217;ble Court may deem fit and proper, under the facts<br \/>\nand circumstances of the case; otherwise the application will<br \/>\nsuffer an irreparable loss.&#8221;\n<\/p>\n<p>Sri G.K. Singh, learned counsel appearing for the petitioners states<br \/>\nthat he can have no possible objection if the order dated 7th<br \/>\nJanuary, 2009 passed by the District Inspector of Schools is set<br \/>\naside and fresh elections are held pursuant to the directions issued<br \/>\nby the Regional Level Committee on 19th November, 2008.<br \/>\n In this view of the matter, the order dated 7th January, 2009 passed<br \/>\nby the District Inspector of Schools is set aside. The District<br \/>\nInspector of Schools shall now hold fresh elections of the<br \/>\nCommittee of Management of the Institution within a period of<br \/>\none month from today pursuant to the directions issued by the<br \/>\nRegional Level Committee on 19th November, 2008.\n<\/p>\n<p>The writ petition is allowed to the extent indicated above.\n<\/p>\n<p>Order Date :- 3.2.2010<br \/>\nSK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Jan Priya Audyogik Junior High &#8230; vs State Of U.P.
