Agnihotri, J.\n\n\n Dated:09\/04\/2008 \n\n: Judgment \n\n                          ORDER\n<\/pre>\n<p>(Passed on 9-4-2008 )<\/p>\n<p>      By  this  petition,  the   petitioner    impugns  the<\/p>\n<p>validity  of  the  order  dated 20-2-2006  (Annexure  P\/18)<\/p>\n<p>passed by the Collector, Surguja, in Case No. 13\/A-89\/2004-<\/p>\n<p>2005  (Nasrin  Bano Vs. Gram Panchayat, Jigdi and  others),<\/p>\n<p>whereby  the application of the petitioner for intervention<\/p>\n<p>\/  impleadment  was rejected  holding that since  the  case<\/p>\n<p>does  not  involve the property or land dispute, therefore,<\/p>\n<p>it   was  not  necessary  to  implead  the  petitioner   as<\/p>\n<p>intervener<\/p>\n<p>2)    The  facts,  in  nutshell, are  that  the  petitioner<\/p>\n<p>applied   for  appointment on the post  of  Urdu   Contract<\/p>\n<p>Teacher,  Class  III (woman), in Janpad  Panchayat  Rajpur,<\/p>\n<p>Gram  Panchayat Jigdi, Rajpur, pursuant to an advertisement<\/p>\n<p>dated 3-10-2003  and  participated in the interview held on<\/p>\n<p>17-2-2004  (Annexure  P-1).    The  selection  process  was<\/p>\n<p>conducted in accordance with the provisions of Chhattisgarh<\/p>\n<p>Panchayat   Samvida   Shala  Shikshak    (Appointment   and<\/p>\n<p>Conditions  of  Service) Rules, 2001.    According  to  the<\/p>\n<p>petitioner, despite the fact that the respondent  No.8  did<\/p>\n<p>not   participate   in  the  selection  process   including<\/p>\n<p>interview, the respondent No.8 was appointed on 5-8-2004 as<\/p>\n<p>Urdu  Contract  Teacher (Annexure P\/9\/).  Being  aggrieved,<\/p>\n<p>the  petitioner made a complaint before the Chief Executive<\/p>\n<p>Officer,  Janpad  Panchayat, Rajpur.  The  Chief  Executive<\/p>\n<p>Officer,   Janpad  Panchayat,   Rajpur,  cancelled      the<\/p>\n<p>appointment     of    the  respondent  No.8   on   8-9-2004<\/p>\n<p>(Annexure P\/10).\n<\/p>\n<\/p>\n<p>3)     Feeling aggrieved, the respondent No.8 preferred  an<\/p>\n<p>appeal before the Sub Divisional Officer, Ambikapur.    The<\/p>\n<p>Sub  Divisional Officer, Ambikapur,  dismissed  the  appeal<\/p>\n<p>on  26-5-2005 (Annexure P\/12) holding that the  appointment<\/p>\n<p>of  the   respondent  No.8 was not in accordance with  law.<\/p>\n<p>Thus,  the order dated  8-9-2004 (Annexure P\/10) passed  by<\/p>\n<p>the Chief Executive Officer,  Janpad Panchayat, Rajpur, was<\/p>\n<p>confirmed.   Further, being aggrieved, the respondent  No.8<\/p>\n<p>preferred an appeal before the Collector, Ambikapur on 14-7-<\/p>\n<p>2005 (Annexure P\/13).   The respondent No.8 did not implead<\/p>\n<p>the petitioner as necessary party before the Sub Divisional<\/p>\n<p>officer,  Ambikapur,  as  well  as  before  the  Collector,<\/p>\n<p>Ambikapur, in appeal.  The petitioner accordingly filed  an<\/p>\n<p>application  on  18-7-2005  (Annexure  P\/16)   before   the<\/p>\n<p>Collector, Ambikapur, for permission   to intervene in  the<\/p>\n<p>matter   being   necessary  party  to  the  dispute.    The<\/p>\n<p>Collector,  Ambikapur,  dismissed the  application  of  the<\/p>\n<p>petitioner  on unsustainable ground that the  dispute  does<\/p>\n<p>not  pertain  to  the  property  or  land,  therefore,  the<\/p>\n<p>petitioner cannot be allowed to intervene in the matter.<\/p>\n<p>4)    Shri Vaibhav Goverdhan, learned counsel appearing for<\/p>\n<p>the  petitioner  submits that the impugned order was passed<\/p>\n<p>in limine,  without considering the fact that  by the order<\/p>\n<p>passed by the Collector, Ambikapur, the petitioner would be<\/p>\n<p>substantially affected as she alone  took participation  in<\/p>\n<p>the   selection   process  and  on  cancellation   of   the<\/p>\n<p>appointment  of the respondent No.8, the petitioner   alone<\/p>\n<p>is   to  be appointed.  The petitioner is a necessary party<\/p>\n<p>to  the  dispute.  The Collector, Ambikapur, ought to  have<\/p>\n<p>considered the application for intervention and impleadment<\/p>\n<p>as  necessary party.  Rejection of the application  on  the<\/p>\n<p>ground  that  in  case  of  property  dispute  alone,   the<\/p>\n<p>petitioner  could be impleaded or allowed to  intervene  in<\/p>\n<p>the  matter, was erroneous.  In all the matters  where  the<\/p>\n<p>party  is  substantially affected  by  a  decision  of  the<\/p>\n<p>Tribunal\/Court, the party should be impleaded as  necessary<\/p>\n<p>party.\n<\/p>\n<\/p>\n<p>5)      Learned  counsel  for the State  submits  that  the<\/p>\n<p>reasons  for not permitting the petitioner to intervene  in<\/p>\n<p>the matter as being necessary party, is not sustainable  in<\/p>\n<p>law.\n<\/p>\n<\/p>\n<p>6)    I have heard learned counsel for the parties, perused<\/p>\n<p>the  pleadings  and documents appended thereto.   It  is  a<\/p>\n<p>clear  case wherein the petitioner was a candidate  in  the<\/p>\n<p>selection  process and if it is found that  the  petitioner<\/p>\n<p>alone  has  participated  in  the  selection  process,  the<\/p>\n<p>petitioner  may  be  entitled to benefit  pursuant  to  the<\/p>\n<p>decision of the Collector, Ambikapur.\n<\/p>\n<\/p>\n<p>7)    In  the  matter of Udit Narain Singh  Malpaharia  Vs.<\/p>\n<p>Additional   Member Board of Revenue, Bihar  and  another1,<\/p>\n<p>the Supreme Court observed as under:\n<\/p>\n<blockquote><p>          &#8220;(7)   To  answer the question raised   it<br \/>\n          would  be  convenient  at  the  outset  to<br \/>\n          ascertain  who  are  necessary  or  proper<br \/>\n          parties in a proceeding.  The law  on  the<br \/>\n          subject is well settled ; it is  enough if<br \/>\n          we state the principle.  A necessary party<br \/>\n          is  one without whom no order can be  made<br \/>\n          effectively;  a  proper party  is  one  in<br \/>\n          whose  absence an effective order  can  be<br \/>\n          made but whose presence is necessary for a<br \/>\n          complete   and  final  decision   on   the<br \/>\n          question involved in the proceeding.\n<\/p><\/blockquote>\n<blockquote><p>          (12)  To summarise in a writ of certiorari<br \/>\n          not  only the tribunal or authority  whose<br \/>\n          order  is  sought to be quashed  but  also<br \/>\n          parties in whose favour the said order  is<br \/>\n          issued are necessary parties.  But  it  is<br \/>\n          in  the discretion of the court to add  or<br \/>\n          implead   proper  parties  for  completely<br \/>\n          settling  all the questions  that  may  be<br \/>\n          involved  in  the controversy  either  suo<br \/>\n          moto  or on the application of a party  to<br \/>\n          the  writ or an application filed  at  the<br \/>\n          instance of such proper party.&#8221;\n<\/p><\/blockquote>\n<p>8)    In  the matter of K.H. Siraj Vs. High Court of Kerala<\/p>\n<p>and  others2,  the  Supreme Court in para  75  observed  as<\/p>\n<p>under:\n<\/p>\n<\/p>\n<blockquote><p>          &#8220;It  was,  therefore, imperative that  all<br \/>\n          the  candidates in the select list  should<br \/>\n          have  been impleaded as parties to be writ<br \/>\n          petitions  as  otherwise  they   will   be<br \/>\n          affected without being heard.&#8221;\n<\/p><\/blockquote>\n<p>9)    In  the matter of  K.M. Rashmi Mishra Vs. M.P. Public<\/p>\n<p>Service  Commission and others3, the Supreme Court observed  <\/p>\n<p>as under.\n<\/p>\n<\/p>\n<blockquote><p>          &#8220;15.  In the aforementioned situation, all<br \/>\n          the  seventeen  selected  candidates  were<br \/>\n          necessary  parties in the  writ  petition.<br \/>\n          The  number of selected candidates was not<br \/>\n          large.    There was no difficulty for  the<br \/>\n          appellant  to implead them as  parties  in<br \/>\n          the  said proceedings.  The result of  the<br \/>\n          writ  petition  could  have  affected  the<br \/>\n          appointees.   They were,  thus,  necessary<br \/>\n          and\/or in any event proper parties.&#8221;\n<\/p><\/blockquote>\n<p>10)   Without  expressing any opinion on the merit  of  the<\/p>\n<p>case,  it is held that the petitioner is a necessary party,<\/p>\n<p>the  petitioner shall be impleaded in appeal pending before<\/p>\n<p>the   Collector,  Ambikapur.   Any  order  passed   without<\/p>\n<p>impleading  the petitioner as party respondent, may  affect<\/p>\n<p>the petitioner substantially.\n<\/p>\n<\/p>\n<p>11)   Accordingly,  the   impugned  order  dated  20-2-2006<\/p>\n<p>(Annexure  P\/18) is quashed.  The Collector, Ambikapur,  is<\/p>\n<p>directed  to  proceed with the adjudication of the  dispute<\/p>\n<p>after  impleading the petitioner as a  party  respondent  .<\/p>\n<p>12)   The  petition is accordingly allowed.
