DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP waives service of Rule.\n<\/p>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with M.Case No. 2\/2010 registered  with<br \/>\nViramgam Rural police station for the offences punishable under<br \/>\nSections 423, 465, 468, 471, 474, 420, 504, 506(2) and 120B of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record and<br \/>\nchargesheet.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the nature of<br \/>\nallegations and  role attributed to the applicant and the fact that<br \/>\nthe accusation against the applicant is of signing as a witness in<br \/>\nthe office of Sub-Registrar on the document\/deed and now the charge<br \/>\nsheet is filed,  without discussing the evidence in detail, prima<br \/>\nfacie, this Court is of the opinion that this is a fit case to<br \/>\nexercise the discretion to enlarge the applicant on bail.\n<\/p>\n<p>\tHence,<br \/>\nthe application is allowed and the applicant is ordered to be<br \/>\nreleased on bail in connection with  M.Case No. 2\/2010 registered<br \/>\nwith Viramgam Rural police station on his executing a bond of<br \/>\nRs.5,000\/- (Rupees five thousand only) with one surety of the like<br \/>\namount to the satisfaction of the trial court and subject to the<br \/>\nconditions that he shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. And 3 p.m for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter. Bail bond to be executed before the lower court<br \/>\nhaving jurisdiction to try the case.\tAt the trial, the trial court<br \/>\nshall not be influenced by the observations of preliminary nature,<br \/>\nqua the evidence at this stage, made by this Court while enlarging<br \/>\nthe applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
