Justice R.BASANT\n\n Dated :17\/08\/2007\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                    Crl.M.C.No.2625 of 2007\n                   ----------------------------------------\n             Dated this the 17th day of August 2007\n\n                              O R D E R\n<\/pre>\n<p>     The petitioner faces indictment in a prosecution under<\/p>\n<p>Section 138 of the Negotiable Instruments Act. Cognizance was<\/p>\n<p>taken. The petitioner had allegedly appeared before the learned<\/p>\n<p>Magistrate.    She was enlarged on bail.                   From and after<\/p>\n<p>09\/02\/2007, the petitioner was not able to appear before the<\/p>\n<p>learned Magistrate. Consequently, the learned Magistrate has<\/p>\n<p>issued coercive processes against the petitioner. The petitioner<\/p>\n<p>finds a warrant of arrest issued by the learned Magistrate<\/p>\n<p>chasing her.\n<\/p>\n<p>     2.   According to the petitioner, she is absolutely innocent.<\/p>\n<p>Her non-appearance was not wilful. The petitioner is willing to<\/p>\n<p>surrender before the learned Magistrate and apply for bail. She<\/p>\n<p>shall co-operate for the expeditious disposal of the case. But she<\/p>\n<p>apprehends that her application for bail may not be considered<\/p>\n<p>by the learned Magistrate on merits, in accordance with law and<\/p>\n<p>expeditiously.    She, therefore, prays that directions under<\/p>\n<p>Section 482 Cr.P.C. may be issued to the learned Magistrate to<\/p>\n<p>release the petitioner on bail when she appears and applies for<\/p>\n<p>bail.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2625\/07                2<\/span><\/p>\n<p>      3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate, the<\/p>\n<p>circumstances under which she could not earlier appear before<\/p>\n<p>the learned Magistrate.\n<\/p>\n<p>      4.    I find absolutely no reason to assume that the learned<\/p>\n<p>Magistrate would not consider the application for bail to be filed<\/p>\n<p>by the petitioner on merits, in accordance with law and<\/p>\n<p>expeditiously. Every court must do the same. No special or<\/p>\n<p>specific directions appear to be necessary. Sufficient general<\/p>\n<p>directions have been issued in <a href=\"\/doc\/147290035\/\">Alice George vs. Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1)KLT 339].<\/p>\n<p>      5.
