Justice K.PADMANABHAN NAIR\n\n Dated :07\/03\/2007\n\n O R D E R\n                          K.Padmanabhan Nair,J.\n\n                        --------------------------------\n\n                             F.A.O.No.285 of 2006\n\n                        --------------------------------\n\n\n                  Dated, this the 7th day of March, 2007\n\n\n                                   JUDGMENT\n<\/pre>\n<p>              The plaintiff in a suit for money is the appellant in this<\/p>\n<p>First   Appeal   from   Order.   He   has   filed   the   suit   for   realisation   of<\/p>\n<p>Rs.25,000\/-   with  interest.  In   the  trial   Court,   the  contention  put<\/p>\n<p>forward   by   the   respondent-defendant   was   that   there   was   no<\/p>\n<p>borrowing. It was contended that she was a subscriber to a chit<\/p>\n<p>conducted by the appellant and she was the successful bidder. At<\/p>\n<p>the time of accepting the prized amount, she affixed a signature<\/p>\n<p>in a blank paper, which contained a 20 paise revenue stamp. The<\/p>\n<p>trial Court decreed the suit. Challenging that, the respondent filed<\/p>\n<p>an appeal before the lower appellate Court. The lower appellate<\/p>\n<p>Court   set   aside   the   judgment   and   decree   and   remanded   the<\/p>\n<p>matter   for   fresh   trial.   Challenging   the   order   of   remand,   the<\/p>\n<p>plaintiff has filed this appeal.\n<\/p>\n<\/p>\n<p>              2.   The   three   main   points   raised   are   that   the   lower<\/p>\n<p>appellate   Court   has   wrongly   cast   the   burden   of   proof   on   the<\/p>\n<p>plaintiff;   that   before   the   trial   Court   three   issues   were   framed<\/p>\n<p>F.A.O.No.285 of 2006<\/p>\n<p>                                      &#8211; 2 &#8211;\n<\/p>\n<p>after hearing both sides and the respondent had, at any point of<\/p>\n<p>time, raised a contention that issues framed are not sufficient or<\/p>\n<p>she   is   unable   to   put   forward   her   defence   because   of   the<\/p>\n<p>vagueness of the issue; and that the oral evidence of P.W.1 was<\/p>\n<p>misread and misconstrued by the lower appellate Court.<\/p>\n<p>             3.   The   judgment   of   the   trial   Court   shows   that   the<\/p>\n<p>original   defence  put   forward  by the  respondent  was   that   at  the<\/p>\n<p>time   of   receiving   the   prized   chit   amount   conducted   by   the<\/p>\n<p>appellant, she affixed her signature on a 20 paise revenue stamp.<\/p>\n<p>At the time of oral evidence, her case was that the appellant has<\/p>\n<p>removed the twenty  paise revenue stamp from  the  blank  paper<\/p>\n<p>and   affixed   2   one   rupee   stamps   on   that   paper   and   some   other<\/p>\n<p>person had forged her signature on those stamps. So, it is a case<\/p>\n<p>in   which   the   respondent   challenge   the   genuineness   of   the<\/p>\n<p>signature itself. When a person raises a specific  contention  that<\/p>\n<p>he\/she is not the author of the disputed signature, the burden is<\/p>\n<p>on   such   party   to   prove   the   same.   The   opposite   party   had   no<\/p>\n<p>burden to discharge in this regard.\n<\/p>\n<\/p>\n<p>             4.   Regarding   the   re-casting   of   issues,   the   trial   Court<\/p>\n<p>shall   consider   the   arguments   of   both   sides   and   take   a   decision<\/p>\n<p>F.A.O.No.285 of 2006<\/p>\n<p>                                         &#8211; 3 &#8211;\n<\/p>\n<p>whether  any  additional issues  are  to  be  framed  in  this   case. Of<\/p>\n<p>course, the lower appellate Court had made an observation that<\/p>\n<p>there   are   some   inconsistencies   in   the   oral   evidence   of   the<\/p>\n<p>plaintiff. When the lower appellate Court thought it fit to give an<\/p>\n<p>opportunity   to   the   defendant,   it   ought   not   have   made   such   an<\/p>\n<p>observation   so   as   to   prejudicially   affect   the   plaintiff.   So,   that<\/p>\n<p>finding is vacated and there will be an open remand of the entire<\/p>\n<p>case.   The   trial   Court   shall   try   and   dispose   of   the   suit   afresh   in<\/p>\n<p>accordance with law, untrammelled by any observations made by<\/p>\n<p>the lower appellate Court in the remand order. It is made clear<\/p>\n<p>that there is no need for a de novo trial.
