It is this<br \/>\njudgment and order which has been assailed in the aforesaid Criminal<br \/>\nAppeal, which has been admitted.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr.Lakhani for the applicant has submitted that the<br \/>\napplicant was on bail during the pendency of the trial. He further<br \/>\nsubmitted that considering the nature of offence, the applicant is<br \/>\nrequired to be released on bail.\n<\/p>\n<p>5.\tLearned<br \/>\nAPP Mr.Pujari resisted the application.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe fact that the applicant was on bail during the pendency of trial<br \/>\nand considering the nature of offence, the application deserves to be<br \/>\nallowed.\n<\/p>\n<p>7.\tIn<br \/>\nthe facts and circumstances, the present application stands allowed.<br \/>\nThe order of sentence shall remain suspended till the appeal is<br \/>\nfinally heard.  The applicant is ordered to be released on bail on<br \/>\nhis furnishing a bond of Rs.5,000\/- (Rupees Five thousand only) with<br \/>\none surety of the like amount to the satisfaction of the trial Court<br \/>\nand subject to the conditions that the applicant shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse \this liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper with  the evidence or \tpressurize the prosecution<br \/>\nwitnesses or \tcomplainant in any manner.\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>(d)\tsurrender<br \/>\nhis passport, if any, to the lower \tCourt, within a week.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
