Aslam Ansari son of Amjad Ansari\n                                  Versus\n                            The State Of Bihar\n                                 -----------\n<\/pre>\n<p>3.   26.7.2011            Heard learned Counsel for the petitioners and<\/p>\n<p>                 the State.\n<\/p>\n<p>                          The petitioners seek bail in Muzaffarpur Sadar<\/p>\n<p>                 P.S. case No.247 of 2009 instituted for the offence<\/p>\n<p>                 u\/ss.20\/22 of the N.D.P.S. Act.\n<\/p>\n<p>                          The petitioners were refused bail by an order<\/p>\n<p>                 dated 27.4.2010 vide Cr.Misc.No.3290 of 2010 with<\/p>\n<p>                 Cr.Misc.No.7441 of 2010 considering the manner in<\/p>\n<p>                 which 35 kgs of ganja was being smuggled by the<\/p>\n<p>                 petitioners.\n<\/p>\n<p>                          The prayer for bail has been renewed on the<\/p>\n<p>                 ground that there has been unnecessary delay in trial.<\/p>\n<p>                          A report was called for from the Trial Court<\/p>\n<p>                 which reveals that the case was pending for some<\/p>\n<p>                 reason or the other including the supply of police papers<\/p>\n<p>                 and finally charge was framed on 22.2.2011, where after<\/p>\n<p>                 the witnesses are not turned up and then the court of 6 th<\/p>\n<p>                 Additional Sessions Judge is vacant. The report of the<\/p>\n<p>                 Sessions Judge, Muzaffarpur reveals that now the case<br \/>\n<span class=\"hidden_text\">                                      -2-<\/span><\/p>\n<p>            has been sent to 5th Additional Sessions Judge,<\/p>\n<p>            Muzaffarpur for trial.\n<\/p>\n<p>                      The Trial Court (5th Additional Sessions Judge,<\/p>\n<p>            Muzaffarpur) is directed to send a list of the witnesses<\/p>\n<p>            fixing specific dates for production of the witnesses<\/p>\n<p>            along with a copy of this order to the S.P., Muzaffarpur<\/p>\n<p>            and the S.P., Muzaffarpur is directed to ensure<\/p>\n<p>            production of the witnesses on the date so fixed by the<\/p>\n<p>            Trial Court so that there is no further delay in trial.<\/p>\n<p>                      The Director, F.S.L. is directed to send the<\/p>\n<p>            F.S.L. report with regard to the present case i.e.<\/p>\n<p>            Muzaffarpur Sadar P.S. case No.247 of 2009 dated<\/p>\n<p>            9.10.2009, if it has not sent already. The Director will<\/p>\n<p>            also cross check the report to ensure that a fake report<\/p>\n<p>            has not been sent to the Trial Court.\n<\/p>\n<p>                      In view of nature of allegations, I am not<\/p>\n<p>            inclined to review the earlier order.
