The brief facts of the case are that, the appellant\n\n No.1 is the wife and appellant Nos. 2 to 4 are the children\n\nof deceased M.K.Ranga Rae, Who was running\n\n\/I\n._____,n\"_._..\u00bb--~--\u00bb---\"\"'\"\"\"\"\"'\n\nI\nz\n6'\n\n\n\nBhuvaneshwari Correspondence College and--'jals_o.lg'duoing\n\nComputer saies and service in hardware':i'tems';a-getting'\n\nmonthly income of Rs.20,000\/gt Thatl_:',_l  atj \n\nabout 11.25 a.rn., when the  \nriding his moped near'~v..::Circlel'  ;l'emple,\nSadashivanagar,  came with\nhigh speed driven   and negligent\nmanner an'd\"dashed,_  lmoped, as a result\nof w?riicl'l.,1: sustained grievous head\n to\ufb02tlielllsame later. On account of\nthe dleath of-:l:\\:'\/:i';lK}Ranga Rao in the motor vehicle\n\nacgcidentflthle'appellants filed the claim petition claiming\n\n   17,90,000\/~ against the respondents.<\/pre>\n
 ‘Tre claim petition had come up for consideration<\/p>\n
beforje :_i<\u00a7,\u00a7s' Tribunal on 219.2005.<\/p>\n
3. The Tribunal, after hearing the learned counsel<\/p>\n
 on both sides and after considering the oral and<\/p>\n
documentary evidence available on record, by the
\njudgment and award, allowed the claim petition in part<\/p>\n
ii<\/p>\n
4<\/span><\/p>\n
and awarded compensation of Rs.5,28.072\/\u00ab~ with interest
\nat 6% per annum from the date of petition till thedate of<\/p>\n
payment. Being dissatisfied with the I  of<\/p>\n
compensation awarded by the Tribunal,  <\/p>\n
have presented this appeal on”the’\u00abgro_iunJd the xsaildf <\/p>\n

4. We have gon.e..thro’ugh ilhelvggrodnds urged in the<\/p>\n
appeal *  ‘Careful consideration of the
\nirnpugnedxh  award and after thorough<\/p>\n
evaluation of th.e…Qr~iginal records available on file, We are<\/p>\n
‘ {or the Tribunal has committed error<\/p>\n
 income of the deceased at Rs.5,000\/– per<\/p>\n
month; without assigning any Valid reasons and without<\/p>\n
 .Vtaki’ng into Consideration the evidence of PW.1 who has<\/p>\n
 stated in unequivocal terms that the deceased was aged<\/p>\n
about 55 years and was an educationalist and<\/p>\n
businessman running Z\/eral institutions as referred

the Bank extracts of the deceased at  19,<\/p>\n
they show that he was getting an <\/p>\n
Rs.l0,000\/– per month. This.-aspect <\/p>\n
not been looked into nor
\nTribunal while determiningilthe  t:he”‘deceasedl.
\nHaving regard to fact;s”‘an_d’circumstances, we take
\nthe income of the — per month<\/p>\n
from all sotttces  .:’.atter”vltdeduyctling his incidental<\/p>\n
expenses:   the institution, payments
\ntowards ‘payment of salaries to the staff<\/p>\n
etc;,\u00bb We take the income of the deceased at Rs.6,000\/-<\/p>\n
  as against Rs.E”),O0O\/– per month taken by the<\/p>\n
it    multiplier adopted by the Tribunal is ‘9’.<\/p>\n
But i–j_n”view of the decision of the Supreme Court in the<\/p>\n
 it caseholf Sarla Verma and others Vs. Delhi Transport<\/p>\n

 {SC}. as the deceased was aged about 65 years as per the<\/p>\n

6. Further the Tribunal has committed error in
\nawarding Rs.3.000\/~– towards funeral eXpenses.V_~which is<\/p>\n
on the lower side. Having regard to the  the<\/p>\n
deceased was a businessman,&\/ having’ n’1ulti_lfarious_V<\/p>\n
activities and also taking into aconsiderationltheexpenses’. <\/p>\n
incurred, we deem it fit to awarti.V_lQs.1.C;_;’iQ0O;’–ll’towards
\ntransportation of dead bo’d.Sf”.and  llexlperises as<\/p>\n
against Rs . 3000 \/\u00bbw awardpealibyt:i1aT::bua’a1.’i’i<\/p>\n
