This Writ Petition is filed seeking a direction to set aside<\/p>\n<p>Ext.P9 and for other reliefs.  Brief facts would reveal that it is the<\/p>\n<p>case of the plaintiff that there was an order of injunction passed<\/p>\n<p>by the court restraining the defendants from doing particular act.<\/p>\n<p>It  is submitted that  in gross  violation of the  order of  the court,<\/p>\n<p>the defendants committed act of trespass and thereby are liable<\/p>\n<p>to be proceeded against under Order 39 Rule 2A of C.P.C. and for<\/p>\n<p>such   an   action,   a   petition   is   already   pending   before   the   trial<\/p>\n<p>court.\n<\/p>\n<\/p>\n<p>      2.  Meanwhile, the plaintiff also moved an application for an<\/p>\n<p>interim mandatory injunction directing the defendants to restore<\/p>\n<p>the property into its original position, which was in existence at<\/p>\n<p>the time of subsistence of the order of injunction.  I am informed<\/p>\n<p>that   violation   of   injunction   petition   is   still   pending   before   court<\/p>\n<p><span class=\"hidden_text\">                                         -: 2 :-<\/span><\/p>\n<p>and   evidence   is   not   taken.     The   interim   mandatory   injunction<\/p>\n<p>application had been dismissed by the court on the ground that<\/p>\n<p>better   evidence   is   necessary   and   it   can   be   done   only   after   the<\/p>\n<p>trial of the case.\n<\/p>\n<\/p>\n<p>       3.   In   this   case   relief   of   interim   mandatory   injunction   is<\/p>\n<p>sought on the ground that the possession of the plaintiff has been<\/p>\n<p>interfered with by the defendants on account of their act, which is<\/p>\n<p>gross   violation   of   the   order   of   injunction.     In   such   cases,   it   is<\/p>\n<p>always the duty of the court not to permit any party to take law<\/p>\n<p>into   their   own   hands   and   do   whatever   they   like.     In   such   a<\/p>\n<p>situation, the court always is permitted to direct the party, who<\/p>\n<p>had   committed   the   act   of   violation   of   injunction,   to   restore   the<\/p>\n<p>property into its original position, which was in existence at the<\/p>\n<p>time of the alleged violation of the order of the court.  The other<\/p>\n<p>types of interim mandatory injunctions are in a case where unless<\/p>\n<p>such   order   is   given   there   will   be   extremely   difficult   for   the<\/p>\n<p>survival of the party and therefore, the court is given the power<\/p>\n<p>in     exceptional   cases   to   grant   the   relief   of   interim   mandatory<\/p>\n<p>injunction.\n<\/p>\n<\/p>\n<p>       4.  So   far  as  this   case  is  concerned,  if   there  is  violation   of<\/p>\n<p><span class=\"hidden_text\">                                          -: 3 :-<\/span><\/p>\n<p>the order of the court, it  is  rather obligatory on the part  of the<\/p>\n<p>court to see that the possession as on the date before the alleged<\/p>\n<p>act of violation is restored.  So, in such a situation, the court has<\/p>\n<p>to   necessarily   enter   into   a   finding   whether   there   has   been<\/p>\n<p>violation   of   the   order   of   the   court.     If   the   court   is   finding   that<\/p>\n<p>there is  violation of   the order  of  the  court,  then  the  court  shall<\/p>\n<p>direct the persons, who had committed the act of violation, to put<\/p>\n<p>the   property   into   its   original   position.     But   in   this   case,   the<\/p>\n<p>petition for violation of the interim injunction is still pending.<\/p>\n<p>       5. I am informed that the matter is also posted for trial in<\/p>\n<p>the list.  I do not want to stay the trial of the suit.  But I make it<\/p>\n<p>very clear that the court below shall proceed independently with<\/p>\n<p>violation   of  injunction  application  separately.    In   case  the   court<\/p>\n<p>finds   that   there  is   violation   of  the   order  of   the  court,  then  it   is<\/p>\n<p>upto   the   court   to   direct   the   party,   who   had   committed   act   of<\/p>\n<p>violation, to restore the property into its original position.   So, I<\/p>\n<p>dispose of the Writ Petition as follows:\n<\/p>\n<\/p>\n<p>       (i)  The  court  below  is   not  prevented  from  proceeding  with<\/p>\n<p>the trial of the case.\n<\/p>\n<\/p>\n<p>       (ii) The court below is directed to consider the violation  of<\/p>\n<p><span class=\"hidden_text\">                                          -: 4 :-<\/span><\/p>\n<p>interim   application  separately  and  not   by taking  evidence  along<\/p>\n<p>with   the   suit   and   dispose   of   the   matter   and   if   it   is   found   that<\/p>\n<p>there is violation of the order of the court, the court is at liberty<\/p>\n<p>to pass orders directing the person, who has committed violation,<\/p>\n<p>to   restore   the   property   into   its   original   position   and   the   other<\/p>\n<p>consequences, which one has to face when there is breach of the<\/p>\n<p>order of the court.\n<\/p>\n<\/p>\n<p>       (iii) The court can proceed independently or simultaneously<\/p>\n<p>but  shall  not unnecessarily protract the  decision in the violation<\/p>\n<p>of   injunction   petition   and   it   shall   try   to   do   it   before   it   finally<\/p>\n<p>dispose of the case.\n<\/p>\n<\/p>\n<p>       Writ Petition is disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                                           M.N.Krishnan,<\/p>\n<p>                                                           Judge.\n<\/p>\n<p>ess 28\/9<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Jose Mathew vs Muhammed Rawther on 28 September, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 25303 of 2007(K) 1.
