Code.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate for the applicant and learned A.P.P. for the<br \/>\n\trespondent. I have also perused the papers produced before me.<br \/>\n\tLearned Advocate for the applicant has contended that no prima facie<br \/>\n\tcase is made out against the applicant. He has also contended that<br \/>\n\tno there is no role attributed to the applicant looking to the FIR<br \/>\n\tand no circumstantial evidence is brought on record. Learned APP has<br \/>\n\tvehemently opposed this application. However, both the parties do<br \/>\n\tnot press for any reasoned order.\n<\/p>\n<p>Having<br \/>\n\theard the learned Counsel for both the sides and looking to the<br \/>\n\tfacts and circumstances of the case, statement of the witnesses, and<br \/>\n\tthe fact that now the charge-sheet is filed,  I am inclined to grant<br \/>\n\tbail to the applicant.\n<\/p>\n<p>Considering<br \/>\n\tthe above, this Application is allowed. The applicants are ordered<br \/>\n\tto be released on bail in connection with CR No. I &#8211; 65 of 2010<br \/>\n\tregistered with Limbayat Police Station, Dist.: Surat, for the<br \/>\n\toffences alleged against him in this application on executing a Bond<br \/>\n\tof Rs.10,000\/- (Rupees ten thousand only)  with one solvent surety<br \/>\n\tof the like amount to the satisfaction of the trial Court and<br \/>\n\tsubject to the conditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and shall cooperate the Investigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nconcerned Sessions Judge.\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>h)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>i)\tshall<br \/>\nmark his presence before the concerned Police Station on 15th<br \/>\nday of every English calender month till the trial against him is<br \/>\ncompleted.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
