Banka.\n                                                ------- Respondents\n                             -----------\n<\/pre>\n<p>2       22.09.2011               Heard      learned       counsel       for        the<\/p>\n<p>                     parties.\n<\/p>\n<p>                                 Learned counsel for the petitioner,<\/p>\n<p>                     while       assailing      the      impugned       order       of<\/p>\n<p>                     termination of service of the petitioner on<\/p>\n<p>                     the post of Panchayat Shikshak, would submit<\/p>\n<p>                     that    when    the    respondents         could   reinstate<\/p>\n<p>                     Brajmohan Das and Archana Kumari on the post<\/p>\n<p>                     of    Panchayat       Shikshak,      there    would      be    no<\/p>\n<p>                     reason for not giving same benefit to the<\/p>\n<p>                     petitioner, inasmuch as, her service was also<\/p>\n<p>                     terminated      along       with     the     aforesaid        two<\/p>\n<p>                     persons.\n<\/p>\n<p>                                 Counsel     for   the    State     has    pointed<\/p>\n<p>                     out     that    the        educational        qualification<\/p>\n<p>                     obtained by the petitioner was not recognized<\/p>\n<p>                     by    the    State    of    Bihar,    inasmuch       as,      the<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>petitioner had passed her examination from<\/p>\n<p>Hindi Sahitya Sammelan, Prayag about which<\/p>\n<p>the issue has stand settled in the judgment<\/p>\n<p>of the Division Bench of this Court in the<\/p>\n<p>case of State of Bihar Vs. Mamta Kumari &amp; Ors.<\/p>\n<p>reported in 2010(4)PLJR 318. He would further<\/p>\n<p>explain that in absence of any pleading in<\/p>\n<p>the writ application that the aforesaid two<\/p>\n<p>persons, namely, Brajmohan Das and Archana<\/p>\n<p>Kumari had also acquired their educational<\/p>\n<p>qualification from Hindi Sahitya Sammellan,<\/p>\n<p>Prayag, the plea of discrimination raised by<\/p>\n<p>the         petitioner      does           not         merit      any<\/p>\n<p>consideration.\n<\/p>\n<p>             In   view     of        the   admitted       position<\/p>\n<p>that     the      petitioner          does       not     hold     the<\/p>\n<p>required qualification, no error can be said<\/p>\n<p>to     be     committed         by     the      respondents        in<\/p>\n<p>canceling the appointment of the petitioner<\/p>\n<p>specially when the issue with regard to the<\/p>\n<p>qualification         acquired         from      Hindi     Sahitya<\/p>\n<p>Sammellan,        Prayag        stands       settled       in     the<\/p>\n<p>Division Bench of this Court in the case of<\/p>\n<p>Mamta Kumari (supra).\n<\/p>\n<pre>             As   with     regard          to     the     plea     of\n\ndiscrimination,           the    pleading,         to     say     the\n\nleast,       is   vague    and        on   that,       this     Court\n<span class=\"hidden_text\">                      3<\/span>\n\n\n\n\n<\/pre>\n<p>      cannot rely.
