Majmudar, appearing on behalf of petitioner<br \/>\nand learned AGP, Mr. Sharma, appearing on behalf of respondent no.1.\n<\/p>\n<p>\tI<br \/>\nhave considered submissions made by both the learned advocates.  I<br \/>\nhave also considered prayer made by present petitioner in petition<br \/>\nand also considered the grievance voiced in present petition for<br \/>\nclaiming benefit of continuity of service. Let for that, present<br \/>\npetitioner may make detailed representation giving all details to<br \/>\nrespondents within a period of one month from the date of receiving<br \/>\ncopy of present order.\n<\/p>\n<p>\tAs<br \/>\nand when respondents receive such representation from petitioner, it<br \/>\nis directed to respondents to reexamine and reconsider the grievance<br \/>\nvoiced in present representation as per Government Resolution and<br \/>\nalso to consider one fact that petitioner is selected candidate from<br \/>\nGPSC and entitled for benefits of higher pay scale as per Tikku<br \/>\nCommission and then to pass appropriate reasoned  order in accordance<br \/>\nwith Government Resolution within a period of three months from the<br \/>\ndate of receiving such representation from petitioner.\n<\/p>\n<p>\tLearned<br \/>\nAGP, Mr. Sharma, appearing on behalf of respondent no.1 receive one<br \/>\nletter from Under Secretary of Health &amp; Family Welfare Department<br \/>\n dated 21st January,2011.  In the said letter it is<br \/>\nmentioned that in such kind of cases,the officers those who are<br \/>\nentitled for first, second and third higher pay scale as per Tikku<br \/>\nCommission, for that on the basis of merit \/ seniority, a proposal<br \/>\nhas been made and such aspects are under consideration  of the State<br \/>\nGovernment.  Therefore, according to learned AGP, the grievance which<br \/>\nhas been voiced in present petition, are under consideration of the<br \/>\nState Government.  Therefore, let that proposal which has been<br \/>\nreceived by Health &amp; Family Welfare Department from petitioner<br \/>\nmay  consider it after examining the grievance of present petitioner<br \/>\nand then to decide it as per direction issued by this Court and<br \/>\ncommunicate decision immediately to petitioner.\n<\/p>\n<p>\tIn<br \/>\nview of above observations and directions, present petition is<br \/>\ndisposed  of by this Court without expressing any opinion on merits.<br \/>\nHowever, it is made clear in case, if ultimate decision is adverse to<br \/>\npetitioner, then it is open for petitioner to challenge the same<br \/>\nbefore appropriate Forum in accordance with law.  However, it is<br \/>\nfurther clarified by this Court that if positive stand or decision is<br \/>\ntaken in favour of petitioner then it is immediately to be<br \/>\nimplemented  and extended in favour of petitioner.
