The Delhi High Court Tuesday told the Central Reserve Police Force (CRPF) to reinstate a trooper, sacked for not revealing his involvement in a case when he was eight years old.
“The action of the CRPF for terminating the services of the petitioner without assigning any reason but apparently on the ground that he was guilty of misconduct on account of having made an incorrect statement in the verification form is violation of the principles of natural justice,” a division bench of Justice Gita Mittal and Justice Vipin Sanghi said.
According to Rajesh Kumar, he was just a child at the time of registration of the first information report as well as trial and acquittal and he could not possibly have remembered anything about it at the time of joining service as constable.
“The withholding of the information is not a deliberate and intentional act,” his lawyer R.K.Saini argued.
Rajesh Kumar moved the court after he received the notice of his termination from the CRPF on July 29, 2007, stating that his services would be terminated after expiry of one month notice.
