Bar Council of Gujarat charged Ajitsinh Gohil with professional misconduct and also slapped a fine of Rs 50,000 on him; the lawyer had made allegations against judges .
The Bar Council of Gujarat on Tuesday suspended Bar Association of Gandhinagar president Ajitsinh Gohil for life and fined him Rs 50,000 for professional misconduct.
The decision to suspend Gohil from his duties was made by disciplinary committee chairman Bahardursinh Jadeja, Manoj Anatkar and Jayanti Kankara keeping in mind his misbehaviour in courts.
The BCG has debarred Gohil from his practice as an advocate in any court or before any authority or person in India. Gohil served the Gandhinagar Bar Association as its president for six years.
The fine will have to be deposited in 30 days of the order in the account of Gujarat Advocate Welfare Fund.
Gandhinagar judiciary had sent a confidential letter to the High Court of Gujarat stating his misbehaviour in court. It was stated in the letter that he uses abusive language and goes on strike on any small topic thereby hindering the court proceedings.
The High Court had then asked BCG to initiate investigation against him. The disciplinary committee then issued a suo motu against DC case number 15/2010 and started investigation.
Recently, Gohil had created a scene in the court in the case of the arrest of Deepaba Parmar, an accused in a land scam. Several applications were made against him by the public prosecutors and senior lawyers following this.
According to bar council sources, Gohil had made allegations against magistrates and district court judges, who wrote to the chief justice. He referred the matter to the bar council.
All advocates should behave and conduct themselves in a befitting manner as per the provisions of Advocates Act and Bar council rules. Anybody exceeding the limits deserves to be punished as per law. Hence laws and judges must be respected. Needless to say as per section I of chapter II of Bar council of india rules, which relates to the duties of an advocate towards court, it is clearly specified that advocates must maintain a respectful attitude towards the courts by bearing in mind that that the dignity of judicial office is essential for the survival of a free community. Similarily the BCI rules at the sametime allows the advocates to fearlessly uphold the interest of his client by conducting himself as per rules. Lastly the BCI rules also permits the Advocates as a matter of right, to submit his grievance to proper authorites whenever there is a proper ground for serious complaint against a judicial officer. Therefore in the background of the above enabling provisions at the disposal of advocates, it is not at all proper and fair to use abusive language or disrupt court proceedings. In fact it amounts to taking law into their own hands which is itself illegal and impermissible. Hope a cordial and respectful relationship is always maintained between the Bar and Bench.
