Hasan Ali challenges custody in Supreme Court

Hasan Ali, the country’s top-most tax evader under investigation for stashing away huge amounts of money abroad, Thursday challenged in the Supreme Court his “illegal” custody of the Enforcement Directorate (ED).

An apex court bench of Justice B Sudarshan Reddy and Justice SS Nijjar, however, declined to entertain Ali’s plea on the grounds that there was no application or petition before it challenging his custody of the ED for three days.

The court told counsel Santosh Paul appearing for Ali that it would not entertain any oral submissions.

Paul told the court that the ED obtained Ali’s three-day custody without the special court having seen the apex court order that allowed Ali to move afresh for his bail (before the special court).

The apex court said that if Ali feels that the special court’s order granting three-day custody was erroneous, he could follow the legal recourse by moving the high court challenging the order.
