HC’s contempt notice to Delhi govt on RWA’s plea

The city government was today directed by the Delhi High Court to respond to a contempt plea charging the authorities with non compliance of the court’s previous order to build a foot overbridge(FoB) near Jangpura Metro station in six months.

Issuing contempt notices to the Chief Secretary of Delhi Government, the Transport Commissioner and the General Manager of Delhi Integrated Multi-Model Transit System(DIMTS), Justice Rajiv Shakdher sought their replies by December 18 on the contempt plea filed by Jangpura Residents Welfare Association (JRWA).

Filing the petition through counsel R K Saini, the Association sought the court to initiate contempt proceedings against the concerned officials for “non-compliance of a division bench’s April 25 order.”

According to the plea, while hearing a PIL, a division bench had directed the government to complete the construction of foot overbridge at Lala Lajpat Rai Marg connecting Jangpura metro station to bus stop in six months as the matter is in public interest but the construction has not started as yet.

The government so far has issued a tender notice inviting tenders for construction of the bridge and the completion period for work was given upto July 31, 2013 which is 15 months from the date of court’s earlier order, as per the plea.

“The respondents have deliberately and willfully flouted and disobeyed the order of this court and have behaved in a most obstinate and arrogant manner, bringing the court and its order into disrepute. They are thus guilty of committing gross contempt of court and liable to be suitably punished for the same,” the RWA said.
