Judge recuses from hearing Israeli diplo attack case

The sensational Israeli Diplomat attack case of 2012 will now be heard by an another court here after the judge, who was earlier conducting the proceedings in the case, recused himself from hearing the matter.

The case, which was being heard by ASJ Reetesh Singh, was transferred to another court after accused Syed Mohammad Kazmi moved an application, saying the judicial officer had earlier appeared as a lawyer in an arbitration proceeding on behalf of an institution with which the accused was associated.

“After going through the contents of this application, I am of the opinion that I should not hear this case any further,” the judge had noted in his order.

District Judge Amar Nath had then transferred the case to the court of ASJ Neena Bansal Krishna for further hearing.

Additional Sessions Judge (ASJ) Neena Bansal Krishna today posted the case, in which journalist Syed Mohammad Kazmi was chargesheeted, for arguments on charge for November 21.

Kazmi, who is presently on bail, has been chargesheeted by the special cell of Delhi Police for alleged offences under various provisions of the Unlawful Activities Prevention Act (UAPA), the Explosive Substances Act and other sections of the Indian Penal Code (IPC) including, attempt to murder.

The police charge sheet had also named Iranian nationals Houshang Afshar Irani, Masod Sedaghatzadeh, Syed Ali Mehdi Sadr and Mohammed Reza Abolghasemi as suspects in the case.

According to the police, Kazmi, who was arrested on March 6, 2012, had allegedly conspired with the suspects to execute the attack.

The Israeli diplomat, Tal Yehoshua, and driver of the embassy vehicle, were among four people injured in a blast here on February 13, 2012.

According to the charge sheet, Houshang Afshar Irani went to Bangkok and then to Kuala Lumpur, while Masod Sedaghatzadeh has been under detention in Malaysia since March 14.

Police has said Irani had visited India on April 25, 2011 and left the country on May 6, 2011. He had returned to India again on January 29, 2012, but left for Malaysia on February 13, 2012 evening, hours after the attack on the Israeli diplomat.
