A man has been sentenced to seven years in jail for robbing a man of Rs 1000 at knife point by a Delhi court.

Additional Sessions Judge Pankaj Gupta handed down the minimum jail term to Delhi resident Ajay noting that he was a first time offender, while holding him guilty of the offences including robbery with attempt to cause grievous hurt and house trespass under the IPC.

“It can be held that the prosecution has proved beyond reasonable doubt that the accused along with a juvenile had committed house-trespass having made preparation for causing hurt to victim and actually put him in fear of hurt,” the judge said.

The court, however, rejected the contention of the accused that recovery of the knife used to threaten the victim was doubtful as no independent witness joined the proceedings.

“It can be held that the recovery of the knife stands proved and inspires confidence of this court. Mere non-joining of public person is not fatal to the case of prosecution,” it said.

According to the prosecution, on May 8, 2014, the accused, along with a juvenile, trespassed a house and robbed the servant of Rs 1000 at knife point.

The juvenile was caught by the servant and his masters brother after which the other accused, Ajay, was also found and arrested.

Charges were framed against Ajay for the offences under sections 452(house trespass), 392(robbery), 397 (robbery with attempt to cause grievous hurt) and 411(dishonestly possessing stolen property) of the IPC.

During trial, the accused had denied the allegations and claimed he was falsely implicated. He had sought leniency from the court on the ground that he had no previous criminal record.
