A man, caught possessing heroin outside a government hospital here, has been sent to 10 years in jail by a Delhi court which also imposed a fine of Rs one lakh on him.

Special NDPS judge Anuradha Shukla Bhardwaj awarded the minimum punishment prescribed for the offence to 22-year-old Rehman, a resident of Bareilly in Uttar Pradesh, under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

Rehman was convicted for possessing 320 gram of heroin in December 2010.

“Keeping in view the facts and circumstances of the case, since the commercial quantity of heroin has been recovered from the possession of the convict, he cannot be convicted for anything less than the minimum prescribed punishment for the offence.

“The ends of justice would be sub?served if the convict is sentenced to undergo rigorous imprisonment for a period of 10 years under the provisions of the NDPS Act and also directed to pay a fine of Rs one lakh,” the court said.

According to the prosecution, the narcotic cell received an information on December 16, 2010 that Rehman was bringing heroin from his village Faridpur for selling it in Delhi. He was likely to supply heroin in large quantity to someone outside LBS hospital in east Delhi.

The team went to the spot outside the hospital and when Rehman came there, he was identified by the secret informer.

Rehman was caught by the officials of crime branch of Delhi Police and was found possessing a polybag containing 320 gm of heroin and was arrested.

During the trial, Rehman claimed that he was innocent and was falsely implicated in the case.

While holding him guilty, the court said the witnesses have duly proved that 320 gm of heroin was recovered from Rehman’s possession.
