No criminal proceedings against Malayalam actor Priya Prakash Varrier: SC

NEW DELHI: The Supreme Court today dismissed the criminal proceedings filed against South Indian actress Priya Prakash Warrier on various charges for hurting religious sentiments. A bench of Chief Justice Deepak Mishra, Justice AM Khanvilkar and Justice DY Chandrachud said that no complaint would be entertained against the actress or the filmmakers because of picturisation of this song.

A bench led by Chief Justice Dipak Misra also restrained filing of fresh complaints against the actress or the filmmakers under section 295A of Indian Penal Code that punishes any act intended to insult religious sentiments of a religious group.

Even if it’s (winking scene) true, it does not come within the ambit and sweep of section 295A,” the court said.

CJI Dipak Misra went to the extent of remarking to the State counsel, somebady in a film sings a song and u have no other job but to file a case.

An FIR was registered in a Hyderabad police station by a person claiming that the song had hurt his religious sentiments.
