The Delhi High Court has set aside its earlier order of sending a businessman for mental check-up for recording court proceedings on his mini-tape recorder.<\/p>\n
The division bench of Justice Sanjiv Khanna and Justice R.V. Easwar Friday said that till Jan 23, the next date of hearing, the order for mental check-up of Deepak Khosla will remain suspended.<\/p>\n
The bench set aside Justice Suresh Kait’s Jan 4 order that Khosla “needed check up” at the Institute of Human Behaviour and Allied Sciences (IHBAS), saying he had been continuously disrespecting the court’s orders telling him not to record the proceedings.<\/p>\n
Justice Kait directed the medical superintendent of IHBAS to assess Khosla to check his mental stability.<\/p>\n
“The medical superintendent is directed to constitute a medical board, who shall further examine and assess Khosla on daily basis for a fortnight and, thereafter, submit the report before this court,” Justice Kait ordered.<\/p>\n
Setting aside the order, Justice Khanna and Justice Easwar said: “The medical records maintained by the IHBAS will be produced in the court Jan 23.”<\/p>\n
Justice Kait’s order was passed on the basis of the high court\u2019s vigilance department probe report prepared after examining the mobile phone and a tape recorder recovered from Khosla who was caught recording the court proceedings Dec 23, 2010.<\/p>\n
The court in 2011 dismissed the plea of Khosla seeking audio-video recording of its proceedings as well as the hearings in subordinate courts.<\/p>\n
