A Delhi court has acquitted three accused facing trial in an attempt to murder case after material witnesses did not support the prosecution allegation and the victim failed to identify them.<\/p>\n
Additional Sessions Judge Rajneesh Kumar Gupta Friday acquitted three accused, Gulfam, Nurhassan and Irfan, observing that the eyewitness of the case has not supported the case of the prosecution.<\/p>\n
According to the prosecution case, on March 16, 2011, all the three accused with common intention caused injuries to a person named Imran with a knife.<\/p>\n
The court had framed charges against the trio for the offence of attempt of murder Nov 8, 2011.<\/p>\n
The prosecution had relied upon four witnesses to support his case.<\/p>\n
During cross-examination, Imraan had deposed that some unknown persons came towards him and suddenly stabbed him. He told the court that the person who stabbed him was not present in court.<\/p>\n
The victim’s brother Salman also denied seeing the accused.<\/p>\n
The court observed that the witness had denied the prosecution allegation against the accused. “Victim and eyewitness has not supported the case of prosecution,” said the court.<\/p>\n
The court said that from the evidence of material witnesses, prosecution failed to prove any allegation against the accused.<\/p>\n
“Accordingly, accused persons are acquitted of the offence punishable under Section 307\/34 (attempt to murder\/ acts done by several people with common intention) of the Indian penal code (IPC),” said the court.<\/p>\n
