A Delhi court Friday allowed the plea of journalist Syed Mohammed Ahmad Kazmi, held for his alleged role in the Feb 13 blast in an Israeli embassy car here, to supply him the copy of the remand application.<\/p>\n
Additional Sessions Judge Surinder Singh Rathi allowed Kazmi’s plea and set aside the magistrate’s order.<\/p>\n
The court said that he must be supplied with the copies of the remand papers which are not secret documents.<\/p>\n
The court added that Kazmi had a fundamental right to be informed about the grounds and documents based on which his detention was being extended from time to time.<\/p>\n
Judge Rathi was hearing a revision petition filed by Kazmi’s counsel Mehmood Pracha, Gajinder Kumar and Sheikh Faraz Iqbal challenging the magisterial court order.<\/p>\n
Kazmi’s counsel requested the court to set aside the magistrate’s order and grant certified copies of the records pertaining to judicial and police custody of the applicant.<\/p>\n
“The accused (Kazmi) has a constitutional right to know the grounds and reasons of his prolonged detention and the same cannot be denied to him under any circumstances,” said Kazmi’s petition.<\/p>\n
Kazmi had told the court in his petition that the magistrate court’s order denied him access to the order authorising his detention.<\/p>\n
