Taking a serious note of complaints made by four persons against the Sessions Judge who absolved former Minister Rajendra Rathore of the charge of involvement in the Dara Singh fake encounter case, the Registrar (Vigilance) of the Rajasthan High Court on Friday summoned them for giving evidence to support their allegations.<\/p>\n
All four, including Sushila Devi, the wife of the victim, and Rajaram Meel, president of the Jat Mahasabha, appeared before the representatives of the Chief Justice at the High Court Guest House in Gandhi Nagar to make their testimonies.<\/p>\n
While one of them, advocate Sumer Singh Ola, had complained to Chief Justice Arun Kumar Mishra and President Pratibha Patil in writing about the said \u201cmisconduct\u201d of Judge P.C. Jain who freed Mr. Rathore on May 31 even before a trial, the others had made statements airing their views on the Judge’s order at a press conference. They also reportedly alleged the role of two High Court judges in influencing the decision.<\/p>\n
\u201cI cannot tell you what I told the representatives of the Chief Justice,\u201d said Mr. Ola when contacted. \u201cAll four appeared before the officers and gave evidences separately,\u201d he informed.<\/p>\n
Mr. Ola had mentioned in his complaint that Mr. Jain in his 20 years of career in the judiciary never had discharged a murder case accused without trial. \u201cThe Dara Singh fake encounter killing is a serious case monitored by the Supreme Court. Any allegation of foul play should be cleared immediately,\u201d he noted. Soon after Mr. Rathore’s release Ms. Sushila Devi asked the High Court authorities to shift the case out of Rajasthan to ensure a \u201cfair trial\u201d.<\/p>\n
Mr. Jain had freed Mr. Rathore, chief whip of the BJP, and dismissed the charges against him with the observation that the Central Bureau of Investigation, probing the encounter case on the directive of the Supreme Court, could not establish the link. The CBI had based the phone calls made by Mr. Rathore to A.K. Jain, the Additional Director-General of Police, as the evidence on involvement of the former in the \u201cconspiracy\u201d to eliminate Dara Singh, a liquor smuggler from Churu district in an encounter on the suburbs of Jaipur in October 2006.<\/p>\n
Mr. Rathore came out of the Central Jail, Jaipur, after 54 days of incarceration alleging a conspiracy by the CBI and the Congress Government in the State to finish him off politically. Sixteen others, including A. K.Jain and Inspector-General of Police A. Ponnuchami are in jail.<\/p>\n
