{"id":21103,"date":"2012-06-22T17:05:46","date_gmt":"2012-06-22T11:35:46","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21103"},"modified":"2012-06-22T17:10:15","modified_gmt":"2012-06-22T11:40:15","slug":"nri-pay-alimony-wife-living-india","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/nri-pay-alimony-wife-living-india","title":{"rendered":"NRI to pay alimony to wife living in India"},"content":{"rendered":"<p><strong>A Delhi court ordered a\u00a0NRI <\/strong>to pay a monthly alimony of Rs 15,000 to his wife living here.<\/p>\n<p>Additional sessions judge Rajneesh Kumar Gupta ordered Paschim Vihar native who is an NRI,\u00a0Dev Raj Khanna to pay the maintenance to his wife, rejecting his claim that his marriage had never been solemnised with her.<br \/>\n\u00a0<br \/>\n\u201c<span style=\"text-decoration: underline\"><em>There is prima facie material to show that the respondent is the wife of appellant Dev Raj,\u201d<\/em> <\/span>said the ASJ upholding a magisterial court\u2019s ruling for maintenance and dismissing Dev Raj\u2019s appeal against it.<\/p>\n<p><span style=\"text-decoration: underline\"><em>\u201cThere is nothing on record to show prima facie that the respondent (woman) has sufficient means to maintain herself. However, as Dev Raj is the joint owner of property situated at Paschim Vihar and owner of one property in United States, he is a man of means<\/em><\/span>,\u201d said the court ordering him to give the alimony.<\/p>\n<p>The sessions court gave the order on basis of a marriage certificate, showing that the woman, a native of Punchkula in Haryana had married Dev Raj on December 19, 2007, at an Arya Samaj Mandir here.<\/p>\n<p>The woman in her complaint to the magisterial court had said after the marriage she began living with Dev Raj at his Paschim Vihar residence since 2009, while he kept on shuttling between India and the USA, often staying there for months altogether.<br \/>\nShe had added that Dev Raj also began neglecting her and even abused her.
