{"id":21218,"date":"2012-06-27T14:00:52","date_gmt":"2012-06-27T08:30:52","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21218"},"modified":"2012-06-27T14:00:52","modified_gmt":"2012-06-27T08:30:52","slug":"guj-hc-cbi-probe-junagadh-hiv-infected-children-case","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/guj-hc-cbi-probe-junagadh-hiv-infected-children-case","title":{"rendered":"Guj HC: CBI probe Junagadh HIV-infected children case"},"content":{"rendered":"<p>The Gujarat High Court has ordered a CBI probe in <span style=\"color: #800000;text-decoration: underline\"><strong>Junagadh HIV-infected children case.<\/strong><\/span><\/p>\n<p>\u00a0In Junagadh government hospital 23 thalassaemic children were infected by HIV during blood transfusion at the state-run Hospital.<\/p>\n<p>Advocate Girish Das had filed a PIL last year demanding a probe into the compensation.<\/p>\n<p>A bench comprising <span style=\"text-decoration: underline\"><span style=\"color: #800000\"><strong>Chief Justice Bhaskar Bhattacharya and JB Pardiwala<\/strong><\/span><\/span>, while handing over the Junagadh HIV-infected children case to the CBI, expressed dissatisfaction over the way in which the case was handled by the Gujarat authorities.<\/p>\n<p>It observed that Sarvodaya Blood Bank, from which the blood was sourced, operated from within the government hospital premises even without having a licence and that it figured on the list of licenced blood banks on the government website too.<\/p>\n<p>This blood bank is run by<span style=\"color: #800000;text-decoration: underline\"><strong> BJP MLA Mahendra Mashru<\/strong><\/span>. Two of the 23 children who contacted HIV have since died.<\/p>\n<p>The High Court has ordered that all investigations papers in the Junagadh HIV-infected children case be handed over immediately to the CBI. The case came to light in September last year when the children undergoing blood transfusion tested positive for HIV.<\/p>\n<p>Girish Das said,<span style=\"text-decoration: underline\"><em> \u201cThe High Court has observed that perhaps it has not happened ever before in India that 23 children were affected by HIV in a government hospital and since this is a rarest of rare case, it warrantees a CBI investigation.\u201d<\/em><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Gujarat High Court has ordered a CBI probe in Junagadh HIV-infected children case. \u00a0In Junagadh government hospital 23 thalassaemic children were infected by HIV during blood transfusion at the state-run Hospital.
