{"id":21442,"date":"2012-07-03T17:58:29","date_gmt":"2012-07-03T12:28:29","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21442"},"modified":"2012-07-03T17:58:29","modified_gmt":"2012-07-03T12:28:29","slug":"split-verdict-3g-roaming","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/split-verdict-3g-roaming","title":{"rendered":"Split verdict on 3G roaming"},"content":{"rendered":"<p><strong>TheTelecom Disputes Settlement and Appellate Tribunal<\/strong> (<strong>TDSAT<\/strong>) on Tuesday gave a split verdict in the 3G roaming case with its chairman allowing operators\u2019 plea against the government order to stop the service, while its member dismissed it.<\/p>\n<p>The two member bench comprising TDSAT chairman <strong>Justice S.B. Sinha and member P.K. Rastogi <\/strong>differed in theirs findings on 3G roaming case.<\/p>\n<p>Justice Sinha allowed the telecom operators\u2019 plea against the government\u2019s directive to stop intra-circle 3G roaming saying that it was violative of natural justice. Mr. Rastogi, however, dismissed telecom operators plea saying they cannot provide roaming.<\/p>\n<p>The chairman was of view that the DoT had not followed the proper procedure and the operators were not given proper time to put their views.<\/p>\n<p>According to Justice Sinha it was a violation of natural justice. Setting aside the DoT\u2019s order to operators to stop ICR roaming, he asked DoT to start the procedure afresh by giving proper time to operators to respond.<\/p>\n<p>Meanwhile, Mr. Rastogi dismissed the appeal of telecom operators saying that they can\u2019t provide 3G services by having mere 2G licence.<\/p>\n<p>TDSAT has a sanctioned strength of three people including the chairman.
