{"id":21492,"date":"2012-07-04T19:12:59","date_gmt":"2012-07-04T13:42:59","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21492"},"modified":"2012-07-04T19:12:59","modified_gmt":"2012-07-04T13:42:59","slug":"lifer-moves-sc-for-release-after-35-years-in-jail","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/lifer-moves-sc-for-release-after-35-years-in-jail","title":{"rendered":"Lifer moves SC for release after 35 years in jail"},"content":{"rendered":"<p>A life convict, who has spent 35 years behind the bars in a murder case, today approached the Supreme Court(SC) \u00a0for getting released from jail.<\/p>\n<p>Agreeing to hear plea of the convict, a bench of justices <span style=\"text-decoration: underline\"><strong>P Sathasivam and Ranjan Gogoi<\/strong> <\/span>issued notice to the Uttar Pradesh government.<\/p>\n<p>SC\u00a0asked the state government to file its reply within four weeks on the plea of Mubarak who pleaded for sympathetic treatment from the court citing its verdict in a case.<\/p>\n<p><span style=\"text-decoration: underline\"><em>&#8220;In this era of fast changing criminal jurisprudence and especially the reformative theory, life convicts deserve sympathetic treatment,&#8221;<\/em> <\/span>the petitioner said in his plea.<\/p>\n<p>Mubarak was arrested along with another person in a murder case in 1977. He was later sentenced to death by the lower court.<\/p>\n<p>He then approached the Allahabad High Court which upheld his conviction but commuted the death sentence to life imprisonment.<\/p>\n<p>The state government then moved the apex court which dismissed the plea for enhancement of the punishment to sentence of death in 1985.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A life convict, who has spent 35 years behind the bars in a murder case, today approached the Supreme Court(SC) \u00a0for getting released from jail.
