Presently he is undergoing life term along with cousin Vikas for murder of\u00a0Nitish Katara\u00a0in 2002.<\/p>\n<p>Senior advocate Ram Jethmalani, while appearing for Vishal before the Delhi high court bench of Justices Gita Mittal and J R Midha, contended that the way the Nitish Katara case \u00a0trial was conducted by the sessions court was not in accordance with the law and the accused deserved either &#8220;acquittal or re-trial&#8221;.<\/p>\n<p><span style=\"text-decoration: underline\"><em>&#8220;We are very much willing for a re-trial,&#8221;Jethmalani<\/em> <\/span>told the bench while beginning final arguments on the convict&#8217;s appeal. The noted lawyer alleged that the prosecution, as well as the trial court judge, did not follow proper procedure during the trial of Nitish Katara case \u00a0.<\/p>\n<p><span style=\"text-decoration: underline\"><em>&#8220;This conviction does not sustain because the proceedings&#8230; cannot be called as trial in accordance with the procedure prescribed by law<\/em><\/span>,&#8221; Jethmalani said.<\/p>\n<p><span style=\"text-decoration: underline\"><em>&#8220;The trial court ignored the fact that the witnesses were not examined by the prosecution properly,&#8221; he further alleged<\/em><\/span>. The court was hearing appeals of Vishal Yadav, his cousin and son of former MP D P Yadav \u2014 Vikas Yadav, and the hired killer Sukhdev Pehalwan. All three are serving life term in Tihar Jail.
