{"id":21547,"date":"2012-07-07T11:17:15","date_gmt":"2012-07-07T05:47:15","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21547"},"modified":"2012-07-07T11:17:15","modified_gmt":"2012-07-07T05:47:15","slug":"sangma-to-move-ec-against-upas-presidential-nominee","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/sangma-to-move-ec-against-upas-presidential-nominee","title":{"rendered":"Sangma to move EC against UPA\u2019s presidential nominee"},"content":{"rendered":"<p><span style=\"color: #800000;text-decoration: underline\"><strong>P A Sangma<\/strong> <\/span>has decided to petition the Election Commission on Saturday against <span style=\"color: #800000;text-decoration: underline\"><strong>UPA\u2019s presidential nominee Pranab Mukherjee<\/strong><\/span>.<\/p>\n<p>The Rajya Sabha secretary general, the returning officer, had on Wednesday rejected their objection that\u00a0\u00a0presidential nominee Mukherjee should be disqualified as a presidential nominee because\u00a0he had violated office of profit rules.<span style=\"text-decoration: underline\"><em> \u201cWe have decided to petition the Chief Election Commissioner against the returning officer\u2019s order,\u201d<\/em> <\/span>said BJP leader S S Ahluwalia after a meeting at Leader of <span style=\"color: #800000;text-decoration: underline\"><strong>Opposition Sushma Swaraj\u2019s<\/strong> <\/span>residence, which was attended by Sangma, Subramaniam Swamy, Ananth Kumar, and Sangma\u2019s election representative Satya Pal Jain.<\/p>\n<p><span style=\"text-decoration: underline\"><em>\u201cWe have examined the order passed by the returning officer. We are of the view that he has not dealt adequately with the various issues that we raised during the scrutiny process,\u201d<\/em> <\/span>said Jain.<\/p>\n<p>Interestingly, in the proceedings that were made public today, Jain\u2019s primary allegation was that Mukherjee\u2019s resignation letter to the Indian Statistical Institute in Kolkata was \u201cback-dated\u201d.<\/p>\n<p>During the scrutiny proceedings, Jain claimed that Mukherjee continues to hold the office of chairman of ISI, Kolkata. <span style=\"text-decoration: underline\"><em>\u201cThe letter seems to have been forged in the back date. So, my respectful submission is that this is a clear-cut case, open and shut case, that he is holding the office till date. They have not been able to lay down any material about the acceptance of the resignation, about the tendering of the resignation. Even the original has not come. Where is the original document? You are holding an inquiry. Only photocopy has come.
