{"id":21586,"date":"2012-07-09T12:23:38","date_gmt":"2012-07-09T06:53:38","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21586"},"modified":"2012-07-09T12:23:38","modified_gmt":"2012-07-09T06:53:38","slug":"trade-mark-fir-against-canon-tm-violation","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/trade-mark-fir-against-canon-tm-violation","title":{"rendered":"Trade Mark: FIR against Canon TM violation"},"content":{"rendered":"<p>A \u00a0Delhi court has ordered to file FIR for a case of illegal use of &#8220;<span style=\"color: #800000;text-decoration: underline\"><strong>Canon<\/strong><\/span>&#8221; trademark of Japanese multi-national Canon Kabushiki Kaisha by unknown persons.<\/p>\n<p><span style=\"color: #800000;text-decoration: underline\"><strong>Additional Chief Metropolitan Magistrate (ACMM) Manish Yaduvanshi<\/strong><\/span> had asked the police to register the FIR on a complaint of copyright and trademark violation by the Japanese firm.<\/p>\n<p>After registering the case under various sections of the <span style=\"color: #800000;text-decoration: underline\"><strong>Copyright Act and the Trade Marks Act<\/strong><\/span>, the Economic Offences Wing of the city police submitted a copy of the FIR to the court.<\/p>\n<p>In a complaint filed to the court through its authorised representative, the Japanese firm had said in April 2012, it had come to know that some unknown persons or firms are selling laser printers, ink and toner in the market under the trade mark &#8216;Canon&#8217; with its identical 3D logo and in identical packing, which also mentions its (Canon&#8217;s) name and address.<\/p>\n<p>\u00a0The company said the printers being sold by the unknown persons under its trade mark are of inferior quality, which amounts to cheating the entire trade and general purchasing public.<\/p>\n<p>\u00a0Canon said in its complaint to the court that it is the registered proprietor of trademark &#8220;Canon&#8221; and among other goods, its laser printer, ink jet printers and cartridges toners are very famous in India and have a very good reputation because of its performance and efficient quality.<\/p>\n<p>\u00a0It had said the matter needs to be thoroughly investigated by the police to ascertain the identity of those involved in the violation of its trademark.<strong> <\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A \u00a0Delhi court has ordered to file FIR for a case of illegal use of &#8220;Canon&#8221; trademark of Japanese multi-national Canon Kabushiki Kaisha by unknown persons.
