{"id":21678,"date":"2012-07-12T11:06:51","date_gmt":"2012-07-12T05:36:51","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21678"},"modified":"2012-07-12T11:06:51","modified_gmt":"2012-07-12T05:36:51","slug":"no-disclosure-under-rti-at-pre-detention-stage-sc","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/no-disclosure-under-rti-at-pre-detention-stage-sc","title":{"rendered":"No disclosure under RTI at pre-detention stage: SC"},"content":{"rendered":"<p><span style=\"text-decoration: underline\"><em>The state is not under an obligation to disclose under the Right to Information Act(RTI) \u00a0the grounds of detention of a person under a preventive detention law before his arrest, the Supreme Court has ruled<\/em><\/span>.<\/p>\n<p>\u00a0\u00a0A three-judge bench of justices <span style=\"color: #800000;text-decoration: underline\"><strong>Altamas Kabir, Gyan Sudha Misra and J Chelameshwar<\/strong><\/span> said a detune under the preventive detention laws like NSA, COFEPOSA etc is not required to be treated in the same manner as a person arrested in connection with the commission of an alleged offence.<\/p>\n<p><em>\u00a0<span style=\"text-decoration: underline\">\u00a0&#8220;Since clause (5) of Article 22 provides that the grounds for detention are to be served on a detune after his detention, the provisions of Section 3 of the RTI Act, 2005, cannot be applied to cases relating to preventive detention at the pre-execution stage&#8221;.<\/span><\/em><\/p>\n<p>\u00a0<span style=\"text-decoration: underline\"><em>\u00a0&#8220;In other words, Section 3 of the RTI Act has to give way to the provisions of Clause (5) of Article 22 of the Constitution,&#8221;<\/em> <\/span>said Justice Kabir, writing the judgement for the bench.<\/p>\n<p>\u00a0\u00a0Under <span style=\"color: #800000;text-decoration: underline\"><strong>Article 22 of the Constitution<\/strong><\/span>, the authorities are under an obligation to disclose to a person the reasons for his or her arrest.<\/p>\n<p>\u00a0\u00a0&#8220;<span style=\"text-decoration: underline\"><em>Notwithstanding the provisions of the RTI Act, 2005, the State is not under any obligation to provide the grounds of detention to a detune prior to his arrest and detention, notwithstanding the fact that in the cases of Choith Nanikram Harchandai and Suresh Hotwani &amp; Anr, the grounds of detention had been provided to the detune under the RTI Act, 2005, at the pre-execution stage&#8221;.<\/em><\/span><\/p>\n<p>\u00a0\u00a0&#8220;<span style=\"text-decoration: underline\"><em>The procedure followed under the RTI Act, in respect of the said writ petitions cannot and should not be treated as a precedent,<\/em><\/span> &#8221;
